A federal grand jury on Wednesday accused a Mound man of a real estate investment and mortgage reconveyance scheme that allegedly bilked investors, mortgage lenders, and distressed homeowners of more than $2.5 million.
Timothy Lynn Beliveau, the owner of two Twin Cities-area real estate firms, allegedly used investors’ money to purchase distressed real estate at inflated prices in a scheme to fund a lavish lifestyle, which included elective surgeries, a boat, and a Florida vacation home.
The fraud allegedly happened between January 2004 and July 2007.
The indictment, which was made public on Thursday, says that Beliveau’s U.S. Housing & Financial Services, LLC, promoted a mortgage reconveyance program in which homeowners facing foreclosure could sell their homes to investors, continue to live in their homes, and then repurchase the homes once their credit was restored.
Beliveau allegedly set up escrow accounts to pool the equity of the distressed real estate and homeowners’ monthly reconveyance payments. The government says that investors were told that the accounts would help the homeowners pay back the money loaned to them. Instead, Beliveau allegedly used the money for personal expenses.
“Ultimately, most of the distressed homeowners were unable to reacquire their homes, and the loans taken out by the investors to acquire the distressed homes went into default, in substantial part because [Beliveau] spent the money,” the indictment reads.
Through his mortgage brokerage firm, American Alliance Mortgage Group, Inc., Beliveau allegedly attracted investors by telling them that they would be helping homeowners avoid foreclosure.
Instead, the government says that American Alliance Mortgage charged investors “unreasonable” administrative fees, origination fees, and real estate fees.
Beliveau has been charged with one count of conspiracy, two counts of mail fraud, and nine counts of withholding taxes.
Beliveau faces a maximum sentence of 90 years in prison if convicted on all 12 counts.
