First, my thoughts and prayers go out to both families of the victims involved in this collision. I read this story and agree that the 15 year old child should have NEVER been driving the vehicle to begin with. The law is clear on this issue. Even if he or she had a permit, the DMV states that a parent, guardian, spouse or adult 25 years of age or older, who has a valid California driver license, must be present in the vehicle. WHY? Because we know that a 15 year old kid does not have the maturity or experience to operate a motor vehicle. If the vehicle was being driven by a licensed driver, I would hope that the driver would recognize that the vehicle was having problems and pull over to the shoulder (which is on the right side) like we are supposed to do. Do I find fault with this 15 year old? YES! If he had not been driving, this accident may have not happened in the first place. It's also unclear, according to the article, if this 15 year old kid caused a collision before the fatal accident which may have caused his vehicle to be disabled. In case you are wondering: to get a driver’s license you must be 16 years old

AND
Have held your permit for a minimum of six months

AND
Have completed driver education

AND
Have completed 6 hours of professional driver training

AND
Have completed 50 hours of practice with an adult 25 years or older. The adult must have a valid California driver license and certify to the 50 hours of practice. At least 10 of the 50 hours must have been done at night
