You can legally sue the driver's cell phone company if the deadly driver was on the phone

Why is that? Because you wish it? Freaking I dont know what. If someone drives an SUV, that is THEIR business. If someone drives one of those 4 wheeled skate cars, that is THEIR business. If someone drives a motorcycle, that is THEIR business. Thank the good Lord we still live in a country where we can drive what we please. I drive a truck and am tired of others telling me what I should be driving. When you pay for my gas, my taxes on this vehicle, my insurance, then, and only then, can you tell me what to drive. Gads. And normally, I like your posts. |

I was being sarcastic to prove a point thatwhere do you draw the line. Starlyn i doubt you have every waited 5 minute behind any cyclist. That would be almost the entire bottom section of town mountian or most of the folk art climb at the bottom of craggy. We can point fingers all you want. The TRUTH is that drivers violate the law everyday. It is also true that cyclist break laws everyday. It is still true that pedestrians break the law as well EVERYDAY. No one needs to banned from the roads, but everyone need to drive their vechicle or them selves in a more curtious mannor and the roadway would be much safer for all. |

Reverse that arguement the one road cyclist ar not allow on is the interstate. Wide shoulder gradual turns plenty of room. Speed similar to that of most residential drivers why are cyclist not allowed there? |

I was out in Denver a few weeks ago - I saw one interstate that specifically said "cyclists ride on shoulder" - I wouldn't be surprised if there are more. Sounds like progress to me! |

I was surprised by that but it's true: "...Colorado law allows bicycles on the Interstate when there is no suitable alternate route.‘Suitable alternate route’ was later defined to mean no paved alternate route within one mile. I-25 from Wellington north to Cheyenne permits bicycles as well as a short section nearer Fort Collins. The Interstate is clearly marked where bicycles are permitted, and they are essentially permitted where you need to use them. Don’t expect to pedal through the Eisenhower tunnel on I-70, though." http://users.frii.com/pedal/laws.htm That wouldn't apply around here, though, as we have many alternate routes to get somewhere other than an Interstate, as is the case in less densely populated states. |

I do beleive this was a tragic accident. But as you all know, the people on the bicycles sometimes do not get out of the road, as they rely on the cars or trucks to simply try to avoid them. Here in S.C. after a bicyclists was killed by a elderly driver with poor vision, the Share the Road campaigne was enacted. Has it helped? Not really! Because now the bike riders expect you to avoid them even when they are riding in the middle lane of the highway. I personally do not think they should be allowed on major roads or highways.

What Flat Stanley of Candler, NC wrote worries me (Post #4). Whatever happened to "innocent" until proven "guilty"? FS indicted, judged and sentenced SK without knowing all the facts. Sure hope any jury members aren't as myopic as FS.(see #3 http://dictionary.reference.com/browse/myopic )

Please look at the facts in this case. even the police said it was an accident and did not charge the driver. the cyclist were in the middle of the road. the driver was neither drunk nor on cell phone. it was an accident. and stats show several accidents of the same calibur in that area in the past. the DA is the one making the charges.

Investigation into her phone records proved she was not on the phone at the time. Triangulation of the phone towers showed that her last phone activity ceased more than a mile away from the accident. The two bicycle victims had stopped in the middle to fix the man's flat tire. They were in the road on the lee side of a hill where they could not be immediately seen by traffic approaching from lane in which Mrs King was driving. It was a horribly unfortunate series of events but both parties were at fault. What may make this worse is that the driver may have been politically used to gain public support for legislation pending approval. The prosecuting attorney was friend of the victims and a proponent of the bill in question. |
