There is no excuse for this happening to this child at that school. Inexcusable that she wasn't being monitored.

The only problem with this suit is that neither person who filed suit had custody or legal guardianship, don't know if that's gonna fly in court. Sad situation indeed.

I don't know why it wouldn't.
The liberal nuts at the ALCU file lawsuits on behalf of principles or ideals without the actual plaintiff being involved in many cases.
If neither had gaurdianship, I don't know how the monetary judgement would be meted out if awarded.

Maybe if she was claimed as a dependant there would be a precedent?

Her grandmother had legal custody of her. Rhonda is said to be her aunt in the article but she is her sister.

I most certainly believe her grandmother had custody.
I'll play "devils Advocate" for a moment.
If this thing comes to trial, she will be subjected to partial blame by the defendants' lawyers.
Evidently her convictions and sense of school negligence have led her to right a careless wrong, as I in my own opinion feel it to be a case of gross negligence by school officials, myself.

Actually her father has never relinquished legal custody she moved to New Roads with her mother who passed away thus making her father her legitimate legal guardian.He has the only legitimate claim to monetary compensation.

I have see the paperwork. Tesa's grandmother has legal custody of her. Her father had visitation.

You know I don't know how people can think that this family is filing a suit because of Finacial gain. They lost someone that was near an dear to them they loved her unconditional. If you have nothing supportive to say then I suggest that you just don't say anything at all put yourself in there shoes think of Tesa as your child, sister, cousin,granddaughter would you not want justice to be served for what was done to her would you not want to let those that did bully her to know that it's not ok to do so. Let this family do what is right for them to do because if it were child you would do the same

By suing the school, how are you hurting those that bullied her? Most likely if she was bullied, the people that did it don't give 2 farts about the school. The people that will hurt are the children that want to learn, who can't because the school can no longer provide anything for them. Kids just like Tesa.

The school has insurance for things like this. They don't pay it directly.

The point of the lawsuit is to bring to light the failures of all involved. The girl was missing for hours and died on campus. Either everyone didn't care where she was or somebody knew and didn't want to draw attention to themselves. Regardless, if a child dies at school, the school has failed to protect them.
