I attended the anuall meeting that the HOA had last year and received all of the imformation that you ignorant people are refering to. Mowing that Ball Homes was paying for was $33,000.00 per year and they had a contract for that. I saw at the meeting that the current HOA has taken bids from at least 4 Insured Companies to do the mowing and each year they have been able to reduce the mowing cost. Last year they paid about $16,000.00 to some one to have the 24 acres of green space mowed. This year I heard that the reduced the cost to around $13,000.00 for the year. Other costs seem to be going upward thus this is offsetting some of the savings that you all might think is "BEING POCKETED" like someone has said in previous posts. I have heard that at the next anuall meeting there will be a chance for anyone to take over the current positions of the Board Members. Board Members are only allowed to be active on the board for two years if you would just read the bylaws that are posted on the web site you would know this. By the way The HOA still operates under the old Bylaws due to the fact that only about 70 homeowner out of about 350 paying members showed up to vote and that was not enough to vote anything in. So Get off your Asses and do something to contribute to the community instead of BITCHING about what someone else is trying to do for you.I think that the current Board has done a wonderful job taking on a responsibility that was dumped in their laps from Ball Homes back in Feburary 28, 2011. The current persons on the Board are the people that voluntered to do this work. I challenge anyone out there to take on the responsibility of what they have done and continue to organize and control the issues that they have tried to maintain. Ball Homes did NOTHING for this subdivision except F*%K it up for all of us.

I attended the meeting last yr and was unable to go the meetings to vote on the new bylaws. The proxy they wanted us to sign gave them the right to use our vote for 90days, so there was the possibility for them to use my vote for other issues. Since then all I have gotten was an email of a meeting to be held 4hrs later, which violates Article II Section 5 of the bylaws (Notice of Members). If the current B.O.D. can't handle the "responsibility that was dumped in their laps" then they should step down. They "volunteered" to be on the Board at a meeting that most didn't know of or attend. Then held meetings with their neighbors without informing the rest of the "paying members". In my opinion they dropped the ball from the beginning by not including everyone and seems they still want to operate in secrecy.

I continue to question why the homeowners of the adjacent lots to the open spaces cannot buy the land to entend their yards. I would think it would benefit the HOA as it would mean less insurance needed, less maintenance costs for mowing, and revenue from the sale of the land itself.

I would like to extend my lot back 100 ft or more and my neighbors would like the same.

I requested several budget related documents for the upcoming budget meeting. Then they cancelled the meeting. With all the money collected why can't I simply go to my HOA website to find current information. How can we vote out our HOA and start over with more community involvement.
this is not 4-h camp there is no voting them out...stop hiding behind your computer and go to a b@mn meeting and ask there.

I received a letter from the HOA lawyer stating a lien was filled. The HOA dosent care about informing the members but will quickly act to get as much money as they can from members. I will pay my dues but feel that the penalties should be waved for lack of an effective board.
Double check at the courthouse to see if a lien was *actually* filed. If not, file a civil suit against the HOA for harassment, and see about getting a criminal investigation started regarding fraud, extortion, racketeering -- whatever your attorney thinks a letter informing you of a fake lien makes the HOA culpable for.

If the lien actually exists, go ahead and pay your dues plus penalties, then challenge the lien and all HOA expenditures in court. Ask the HOA to produce an agreement with your signature on it. If you never agreed to participate in an HOA, and if it wasn't part of your purchase contract, they won't have any documentation, which means you're not in the HOA. The judge won't have much choice but to order the lien removed. You can probably even get your court costs back, which really shouldn't be more than $500 anyhow.

If you feel that the board ineffective then how did they file a lien on your property for non payment. Why don't you go to a board meeting and ask this same question and maybe you should take your attorney that will represent you and the board could show him as well as you where you can read in your contract that you are a manditory member then you might apologize for you statments that you made about the ineffective board. And for you information there is a scheduled board meeting on August 5, 2012 at 2:00pm at the fire station by Burger King in the lower entrance. You can apologize to them there at that meeting if you are man or woman enough too.

Im sorry apologize?? For what?? this whole thing from the beginning is shady...The HOA has no problem sending you a letter saying you owe money, but I would like know where the HOA came from? when did we vote for this? Did not get a letter on that! I went to one of these so called mettings and was handed a piece of paper stating that I could only ask one question and they had 2 mins to respond.. now thats what you call bullshit!! they said that they need the money for the mowing projects in the neighborhood, well the fee should not be this high? where does the rest of the money go? nobody can tell me that, the HOA doesnt even have enough balls about themselves to sign their name to anything? And then they want to throw threats around about putting liens on our homes like little bullies!!! and just dont understand why the home owners are getting mad?!! REALLY??

Ineffective as far as running a board and communicating with their members. Where did u learn of this meeting. Wasn't from the website. I have sent emails to every email listed on webpage
With no response. How did u learn of the meeting??? There is no way lawn care and insurance can cost as much as they are collecting. I will not apologize to anyone for an ineffective non communicating board. It is pitiful that I have to resort to a public forum to find out about my HOA. Because emails and the website are useless

If you could just go to the web site you would see that it is posted on the site. Quit going to THIS WEB SITE. This is NOT the web site for the HOA. I will make it easy for you and all you have to do is copy and paste it to your browser and it will take you to it. http://bphoaky.org/

The board members of the HOA have not been voted in. The ones who have stepped down are replaced with volunteers. If anything is ever taken to court it would not be valid. By law there must be a vote on board members!

You have a lot to learn. The original member were appointed by Ball Homes back in February of 2011 and then voted in by all of the members that attended the meeting. The members of the board that have left have been reappointed and are voted in by the existing board of directors. Those members can only remain on the board untill the end of the original 2 year term. New members to the board are to be recognized at the annual meeting that is coming up and are to be voted in by the current board. Their tenure will run from 01-01-2013 till 12-31-2014 if I am not mistaken. If you or anyone else is interested on being a board member then you can come to the meeting on Sunday and fill any of the two vacant positions that they still have available. I believe that you can serve multiple terms but do not hold me to that. It should tell you on the web page under the current By-Laws.

Well Ty for finally updating the website. It only took months and a few hundred topic post for a board member to take their extra responsibility and inform members.

Daily Horoscope for May 21

Scorpio

It's a frustrating and rather disappointing day because you have to cope with delays and setbacks to your plans. A travel arrangement may have to be postponed or there could be a hitch about something connected with education. You're also feeling subdued and tired, and you're longing to spend some time on your own although this may not be possible. Don't worry, this difficult mood will soon blow over.
