Worcester man shot and killed by trooper

WORCESTER - State and local police this morning were probing the scene of a fatal shooting of a 43-year-old local man by a state trooper on Irving Street. The shooting occurred about 12:10 a.m. after the trooper attempted to stop the man's vehicle when he ran the license plate and learned the 1997 gray Honda Accord had been reported stolen by a Leicester man

The investigation is still early concerning this tragic incident where someone lost their life. It was reported that the man was shot in the belly. This fact seems odd as the bullet would have had to go through the motor in order to land in his belly unless it was deflected by the stearing wheel.

As I stated, the investigation is in the begining stages. my thoughts and prayers go out to this mans family as well as the officer.

Now, my haters will come on here and state; see "Lynch hates cops". This statement is not true as I respect officers and their jobs which can be dangerous. However, I never take any situation for granted as these haters do.

They do not want an investigation to take place at all. They feel that there is no need to even ask questions. I feel the opposite as we always have to ask questions and to have checks and balances as we have entrusted these officers with deadly weapons.

Now, my haters feel that America should be like China where officers are allowed to be judge, jury and executioner. I strongly feel that America is better than this Nazi system. I hope that the Chinese citizens overthrow their system of government and to make sure that their government respects their human rights.

WORCESTER — Investigators believe they know the identity of the woman with Victor Davila before he was shot and killed by a state trooper early today, but early reports indicate she ran from the stolen Honda Accord before the fatal shooting.
Friends and family of one of Mr. Davila's daughters believe the woman holds answers to what happened just after midnight yesterday at Irving and Chandler streets.
“We're trying to find out who this was,” friend Luis Carmona said.“We're hoping they find her because she could shed some light on what happened.”
It was Mr. Carmona and his family who first identified Victor Davila as the man shot by a rookie state trooper. District Attorney Joseph D. Early Jr. later confirmed the victim's identity.
Mr. Carmona's sister, Marie Carmona, has a 12-year-old daughter, Ashley, with Mr. Davila. They were never married, however Mr. Carmona considered the 43-year-old city man a brother, telling reporters they were once very close and lived together.
He had no clue about the identity of the woman in the car.
State police said they were not releasing the woman's name or photograph because she does not pose a threat. But they want to talk to her.
“We believe we know who she is and have some information about her direction of flight,” state police said in a news release.
The 12:10 a.m. shooting occurred after the unidentified trooper tried to stop a 1997 gray Honda Accord after running the license plate and learning that it had been reported stolen Tuesday by a Leicester man, according to David Procopio, a state police spokesman.
Mr. Davila was inside the Honda, and the trooper was outside his cruiser when the shooting occurred. The trooper is from the most recent class of troopers who graduated in March, state police said.
The trooper works the 11 p.m. to 7 a.m. shift out of the Holden barracks. The trooper, per state police policy, is now on administrative leave for several days, state police said.
The trooper was in front of the Honda when he fired a single shot from his service handgun through the windshield, hitting Mr. Davila in the chest.
He was taken to UMass Memorial Medical Center — University Campus, where he was pronounced dead.
The district attorney's office said the wound was in the chest area. The office of the state medical examiner has accepted the case.
“The trooper was outside his cruiser when Mr. Davila drove the car toward the trooper,” the district attorney's office said in a news release.“Mr. Davila was shot through the windshield.”
The name of the trooper is being withheld pending an investigation.
As family of Mr. Davila's oldest daughter, Ashley, gathered at a West Boylston Street apartment yesterday, they asked reporters to stay back. They were trying to find a way to break the news to Ashley.
Friends said Mr. Davila failed to attend his daughter's birthday last month.
“She always looked forward to her father picking her up,” Mr. Carmona said.“She's going through a rough time.”
Mr. Davila has another daughter — Natalie, 3 — with a different woman.
The Carmona family is hoping answers will materialize about what happened.
“We will get to the bottom of this,” Mr. Carmona said.“We'll find out what really happened.”
State police said in their release that,“a meticulous, thorough, and unbiased investigation into any instance of deadly force by police is critical to preserving the public trust.”
Mr. Carmona stopped by the shooting scene, hoping to get a clearer picture of what happened to Mr. Davila. Mr. Carmona said his sister called him at work this morning to tell him the news.

its never a good idea to steal cars ... or allegedly drive your car towards a guy with a gun... wouldnt you expect to get shot if u drove at a gansgter or an occupier? so why not if u drive towards a cop?......

“I think they strongly reacted. No one needs to get shot over a stolen car,” Mr. Carmona.“He's a rookie state police officer who is probably using his gun for the first time.”
Mr. Procopio said the deadly shot was fired after the suspect ignored repeated requests by the trooper to stop the vehicle, which he said was moving toward the trooper,“putting him in fear for his safety.” He said there was no evidence to suggest the driver was armed.
“While preliminary investigation suggests the trooper discharged his weapon because he was in fear for his safety, we will not reach any conclusions until we have examined all the facts and evidence that can be known,” state police said.
“The Worcester County district attorney will make the ultimate decision as to whether the shooting was justified under the law.”
Mr. Davila was not a violent man, Mr. Carmona said.
He believes Mr. Davila was attempting to run from the car.
According to Mr. Carmona, Mr. Davila's mother and siblings all live in Puerto Rico.
Mr. Carmona said the mother was hospitalized after hearing the news.
Witnesses said they heard one loud bang that prompted them to either look out a window or to go outside to see what had caused it.
One man said he saw someone face-down in the road and the trooper standing by talking into his radio.
The trooper apparently bent over to handcuff the man in the road, but then removed the handcuffs, the witness said.
Two other witnesses said they saw the trooper standing in front of the car. They said the driver was trying to back up and drive away.
They said the trooper yelled repeatedly for the man to stop and then fired into the vehicle when he did not comply.
The men said that once the trooper opened the car door and pulled the man out, the car coasted forward into a small tree.
Brian Trigiano, who lives in a fifth-floor Murray Street apartment facing Irving Street, said he heard a single shot and saw the incident from his open window.
“All I heard was 'Stop,' and then 'Bang,'” Mr. Trigiano said.
“Then I saw the kid fall to the ground. The trooper was right there. He handcuffed him and cleared the area of people. He did a great job.”
At first, Mr. Trigiano said, he thought the woman was the one yelling,“Stop, stop.”
The trooper yelled,“Stay down, stay down,” Mr. Trigiano said.
The trooper then shouted to people at the nearby gas station and asked them what street he was on, Mr Trigiano said.
Mr. Trigiano said state troopers interviewed him early this morning. He said he told them the trooper was in front of the car.
“I was stunned,” Mr. Trigiano said.“I couldn't believe what just happened. My own thoughts were,'Did I just see this happen? Did I just hear this?'"
Investigators will interview witnesses, gather and review physical evidence and review surveillance footage from security cameras that were attached to nearby buildings.

I have problems with Mr. Trigianos' witness statements.
"I couldn't believe what just happened?" My own thoughts were "Did I just see this happen? Did I just hear this?"

Which is it? Did you see it or did you hear it?

Now read this statement "“All I heard was 'Stop,' and then 'Bang,'” Mr. Trigiano said.

At first, Mr. Trigiano said, he thought the woman was the one yelling,“Stop, stop.”
The trooper yelled,“Stay down, stay down,” Mr. Trigiano said."

Now all the other witnesses statedthat Davila was backing up and attepting to get away.

These witnesses stated that the trooper pulled him out of the vehicle and then the vehicle rolled forward.

This guy trig states that the kid fell to the ground.

The video should show what happened as there seems to be very different accounts. There were witnesses on the street level and their was trig five stories up.

I agree with your logic.The gangster who shots at a car goes to jail for his actions.

This case seems way too early to make judgments. There are a lot of different accounts to what took place.

My question is did the officer fire at a car that was moving forward or backwards? Did he fire because the davila guy was backing up to get away? Witnesses state that Davila was backing up.

What was the speed? By all reports it seems like the car was crawling.

Then some witnesses have the trooper pulling davila out of the car and trig has the guy falling to the ground.

I have a feeling that the video is going to fall in a bucket of water if it doesn't show the car moving forward. Just a guess!

Of course you weren't there, so what you are saying is simply heresy. The police nationwide (both state and local) have been given a free pass for shooting people to death: "he/she refused to stop and was driving straight at me".

It's a free pass for executing people; whether justified or not. The police play it for all its worth. After all, saying "he refused to stop and he was driving straight at me" is a hell of a lot easier to defend then "I f-ed up and I overeacted. I should not have shot this man to death".....I don't think that in the entire history of our nation's lawmen any cop has EVER admitted publicly to shooting someone to death by mistake. Of course, chances are high that behind closed doors a cop who has wrongly executed someone has admitted to his superiors that he f-ed up; but by the time the story goes public, the cop somehow did the right thing and the dead man (or woman) was solely to blame. We have heard THAT version of a police shooting literally thousands of times...yet, somehow we have never heard from the police themselves that a cop f-ed up and wrongly executed someone......

.... not all the time they dont.... but i agree, if a guy has a gun, dont drive your vehicle at him.... im betting the trooper gave him an order to stop, or get out of the car, and he didnt.... i also bet the guy who got shot is no angel, or he was tuning his life around yada yada.... but lets see what info comes out b4 we accuse the cop, and if the guys was doing what he was told, and the cop shot him for no reason, he should get the same treatment as the gang bangers who do that... if a gang banger with a gun told me to freeze, i would, id show my hands and hope he didnt shoot me.... i'd do the same with cops too.... that is one tough career ......

so i take it YOU were there? did u film it?.... if the cop shot him in cold blood he should pay, but again thats all hearsay as u said.... seems bad guys have been nailing people like they have a free pass.... ive been stopped alot in my younger yrs, i didnt leave them any reason to think they may have a reason to shoot me..... but strange to hear this in a quiet lil new england city like worcecter huh?...lol.... i wonder if the deceased has a prior rap sheet...

There seems to be problems as the videos have been confiscated as evidence. Was the car backing up? Did thisofficer shoot because the driver was not listening and was backing up to get way?

Tis trig seems to need brownie points as his testimony doesn't add up.

I wouldn't doubt for a second that the driver was simply backing up and the trooper popped his cork because the driver did not heed his mighty commands.

The police these days (both state and local)have forgotten that they are mearly public servants. Nothing more and nothing less. They have twisted things around in their heads were they think that they are lord and master over the general public....they think that everyone should jump whenever they say jump.

Again, I would not doubt for s secaond that this rookie trooper overeacted and there was no need to execute the driver....

How Morbid! So what is your excuse for being so morbid and a NASTY human being? And to imagine that you are a cop! Hey do you think that if you identified yourself as a cop then you would be in trouble?

So what you are saying is that you favor the same justice system that is in place in China?

If the video shows this guy backing up then the trooper is in trouble.

I have trouble with this whole story! If the car was moving forward then how did this officer open the door then pull the guy out as the car then rolled forward? Did he run alongside the car to catch up to it? Witnesses do not state this is what happened.
