Stewart Creekmore was arraigned Thursday, and he is at the Montgomery County Jail facing charges of murder, fetal homicide and assault.

"Our life will never bet the same," says Betty Stull. "It's a wreck that shouldn't have happened."

For Stull, it's hard to believe her brother, 53-year old Henry Bush, is gone.

"He was the greatest. I thank God for having a brother like him."

Bush died less than a month ago when his truck towing an empty cattle trailer was hit near the Midland Trail Industrial Park. We're told his sons witnessed it all.

"For them to seen that happen to their dad, I can only imagine what they're going through," says Brandon Stull, Bush's nephew.

The Montgomery County Sheriff's Department says 24-year old Creekmore ignored traffic lights when he struck Bush from the side.

Creekmore's 21-year old passenger, Stefanie Oatman, who was 6 months pregnant, was also injured. She lost the baby.

Investigators continue to investigate and are awaiting toxicology reports, but they suspect Creekmore was under the influence of drugs at the time of the crash, making Bush's death harder to accept for his family.

"I can't imagine what it's going to be like from now on," says Betty Stull. "There's no reason for this."

Creekmore declined to comment.

This is so sad for all families involved, nothing anyone does can help the pain of losing a baby or family member, I know been there to many times, and this will be very jar on stewert also and his family, hopefully people can make this a life lesson and see that a vehile is not just a fir of transportation but a deadly weapon, wrecks happen all the time some of us live out of terrible wrecks (I did!) and some people don't just because some ppl don't pay attention while driving, I will be praying for everyone involved in this tragedy, may god give you strengh

she was 3 1/2 months.... and was having horrible problems at the doctor all the time and even her own mother said the test proved that the baby died sometime between june 28 and the accident on july 7th. It does not excuse the fact that the accidet occured, but let's get the facts straight! something that i can see is going to be a long haul!! But i am ready, fire away!!

If you read all of my comment you would see that I did not forget about him! I do know some of the younger bushes and am very very sad for their loss, this was not intended towards that great family in no way shape or form!!

..it is a terriable loss to the Bush family and I know first hand that Stewart is very sorry and hurt for what happend to both Mr. Bush & HIS GIRLFRIEND. Nothing can change the fact of what happened that night. I didn't know Mr. Bush personally but from what everyone says he was an aswome man, I do know Mr. Creekmore personally and he's not a bad person as everyone keeps putting him out there to be. People make mistakes and you know what everyone has a time to go and when it's your time to go there isn't anything you can do about it. If it wasn't Mr. Creekmore it could have been someone else and that is what we need to take into consideration. This is all an act of GOD!!!! And I really don't think anyone has any room to talk about anything in this case in regards to Stephanie (Stewart's girlfriend) because if you read the first article after the accident she was not even mentioned and now all of a sudden everyone wants to throw her out there too saying he killed HIS OWN BABY!!!??? He harmed the girl he talked about marrying???!!! OKAY SO THIS WAS HER CAR SO WHY WASN'T SHE DRIVING HER OWN CAR?? Maybe she was unable to drive (do we have reports of what was in her system) especially since she was pregnant, she should have been the sober one and the one behind the wheel of >HER CAR< but for whatever reason she wasn't able to drive and she should have been the one driving her own car!! Or what about the doctors and her own mother teling people that the baby was dead before the accident!!! I think that everyone needs to NOT JUST FOCUS ON STEWART.. THIS WAS AN ACT FROM GOD AND NOTHING CAN CHANGE IT EVERYONE HAS THEIR TIME TO GO!

Definition for an Act of God according to Wikipedia:

Act of God is a legal term[1] for events outside of human control, such as sudden floods or other natural disasters, for which no one can be held responsible.

I don't really know anything about this case accept for what I have read on here, but I do not think this was an act of God. It doesn't sound like a natural disaster to me, and I personnaly believe he should be held responsible.

So being an outsider....you have only read the things they want you to know to bring down stewart. This other person saying he made a choice and "Pulled the trigger" is nonsense...car wrecks happen at that very spot all the time, the lights are messed up! As i said before there are two totally different accident reports, and the very next nite another wreck happened in that same spot, and if i heard correctly that person died as well. It does not excuse in any way that a wonderful man lost his life, but it was not intentional!! He did not go to his house and stab him! And i really feel that this is not the Bush family pursuing this, it is that "mother" . Stewart loved Steph with all his heart and was gonna marry her this summer! But now her mom, her wonderful mom who kicked her out at 16 and never let her back in, is vowing to do whatever it takes to keep him away from her. Ask her when the last time was she saw her daughter face to face, it was long before Stew was in the picture. Steph will remember in time and ask why did her mom finally TRY to be a mom, but not at the right time. The report saying she was 6 months is false, she was only 3 months and having a really hard time with the pregnancy. she had been to the Dr. several times for bleeding and problems, pains and such. Do we have her toxicology reports? sorry, to put that out there, but she is no angel! Her mom told two people that the baby was gone before the accident, so , unless she can hack into the hospital's records, that will be shown! I hate that this has happened to so many people, and I do pray that the Bush family can find some kind of solace someday, the memories of their dad, grandfather, uncle, brother and friend will live on forever in their hearts. <3

I definitely think people should be held responsible for their actions. I think we live in a society in which people are babied around too much and not taught to take responsibility for their actions. I was told this person has been indicted for fetal homicide in the death of the baby. Now, that being said, the only thing that bothers me about the fetal homicide law is that the Supreme Court has legalized abortion and deemed a fetus as not being a life unless it is a viable fetus, able to live outside the mother's womb. So how can we charge someone with taking a life that is not a life? I'm not saying I personally don't believe a fetus is a life, because I personally believe it is. What I am saying is, I don't see how the courts can declare an unviable fetus as not being a life and then charge someone with fetal homicide. That just doesn't make sense.

Great point, but there is also a statute on how old the fetus is before it can be declared a baby...meaning it can live outside the mothers womb w/out life support...That is why they are lying and saying and putting out false paperwork from some doctor she had never seen that is was 6 months, to make it worse than it is...i am not saying he should walk free, but to only pay for the truth not these false accusations!
So, with that being said she was only 3 months and it was not hurt in the accident the mother hurt it enough, like i said where is her toxicology reports? The "Grandmother" told two different people in the hospital, UK, that it was dead before the accident so when they get the reports from the ER the night of the accident, i can not wait!! He would have never ever hurt his soon to be wife and baby!! He wanted that so badly!

You seem to have an agenda here...about only this fetus and the fetal homicide charge. I know nothing about that situation so I won't comment on it, if the baby was already dead and can be proven then he will be cleared of that charge. But he will still be charged with the murder of Mr. Bush right? There was another innocent person involved in this and you seem to keep forgetting that.

I have not forgotten that at all, just want what is correct to be written on this page!! If you had read all of my posts you would see that i know ALL the parties involved! And am very very sad that he lost his life! I do have an agenda, i know how people can talk and make things a lot worse than they are...i am just trying to clear up all the non truth, gossip that is on here. i was w/ them the day before this accident, listening to them talk of marriage and moving out of there! So i have been around a while an know what kind of person he is and she is...I know the younger Bush's but knew of Mr. Bush. AGain we can not take back what happened and i agree that Stewart will be charged with that if the family, which he was distantly related to, will press the issue. We know that, but it is this other agenda from Steph's mom...that is driving a lot of us crazy...she knew she lost her along time ago and this is not the way to recoup what relationship you may have w/ your daughter! By swearing to do what ever in your power to keep them apart! She says Steph does not remember Stewart, but in time, if it is true, she will. Then what MAMA?
