Cant Fight City Hall

The students and staff of Darby Junior High, as well as ardent supporters of the school have raised enough money to purchase a new marquee. Sadly when the school went to apply for a permit to erect the sign it was DENIED by the city. What happens now?

God Forbid the City allow something positive be placed on Grand Avenue! Too bad Darby students don't live in Fianna Hills! Maybe Mr. GOOD should stand up for the people in his ward on this one!

It’s very obvious to me that the Good-time Red-Diaper Doper Baby Commie Liberal Fay-Boys who run Fort Smith have stepped in their own runny baby poop once again. Let’s face it, they crap their Pampers whenever they think America should be defended and because Darby and Darby’s Rangers is associated with good Americans defending America it gives them a bad case of the” let’s don’t do this and be good little commies diarrhea”.

These so called city leaders make me sick and the words Real American and City Leader should never be associated with their names until they step up and with a stroke of the pen fix this problem.

QUESTION?.. What happened to all the factories in FS?... ANSWER. They all moved to 3rd world countries.
QUESTION?.. Who is running FS?.. ANSWER… The same commies who won’t allow a school that has the money for a new sign to have a new sign and they are the same people that allowed the factories to leave.

Does anyone know if the school has been approved for the permit? How long does the process take? If the sign has already been purchased will/can the city actually deny the permit. CRAZY!

I'm pretty sure that if this restaurant is not hooked up to city water, that health department regulations say they don't have to have a restroom. They can have a water source right outside and use a pump system with holding tanks. One for fresh water and one for grey water. But, if they have water lines running into the building, then they are supposed to have bathrooms.

Not only does the Boom A Rang not have a bathroom but they are inside of a "city park" and allowed to no be handicap accessible. Either you are (Phil) White or wrong in this case!

no not Phil White, don't even know the guy, not to mention I'm a female... I have dealt with the Sebastian county health department on a few occasions and this is what the information that was given to me said. Call and ask them for yourself.

If Phil White was really a civic minded guy, he would give that ferris wheel to the city outright and not accept any city maintenance for his little park. The ferris wheel could be moved over by the riverfront park and then this whole discussion would be moot. The city would still have its "beloved" iconic ferris wheel and Phil While could keep his little downtown park to be totally owned, operated and maintained by Phil himself.(Like it should be.)
It simply isn't ethical for Phil White to profit from city services under the guise of philantrophy because he couldn't give that old ferris wheel away to anyone. It's too costly to maintain because parts are nearly impossible to find. The city bailed him out and continues to do so. Why not donate to charity all profits he makes off the park if he's such a great guy?

At least 1 toilet and not fewer than the toilets required by LAW shall be provided. If authorized by LAW and urinals are substituted for toilets, the substitution shall be done as specified.

The code obviously is not enforced in Phil White's diner.

Mobile food establishments have completely seperate rules. I bet they consider this a mobile establishment since it can be moved, even though it probably never will be. Those are the regulations I'm refering to. I guess they figure its not "permanent" so they consider it mobile? We own a mobile business, we do not have to provide a bathroom because we do not have city water running into the building. Its stops right outside the building and we use a pump/tank set up. We wanted to run the water lines into the building and were told if we did we had to provide a restroom, because at that point it becomes a permanent building. I've never been in this diner so I have no clue what it looks like. My parents actually went down there last week to eat and said they set and waited for over 15 minutes just for anyone to acknowledge them, the waitress saw them but never said a word to them, so they got up and left. Doesn't sound like that great a place to me.

5-304.10 Operation
(A) If a water tank in a MOBILE RETAIL FOOD ESTABLISHMENT is to used as an alternative water supply in accordance with Subpart 5-104.12, then it may not operate longer than 14 consecutive days without returning to an approved SERVICING AREA for a period on no less than 24 hours for the purpose of draining, sanitizing, and refilling the water tank from and APPROVED source.
(B) If a water tank in a SEASONAL RETAIL FOOD ESTABLISHMENT or a
RETAIL FOOD ESTABLISHMENT with a temporary interruption of its water supply in accordance with Subpart 5-104.12, then at least every 14 consecutive days, the water tank must be drained, sanitized, and filled with water from an APPROVED source.
