BCSS is the problem. Read the STATE law. Read the County law. Find a good lawyer not associtated with the county. If you have a septic system you can challenge the county. The statement that you have to replace the septic system if it "fails" should be challenged. If your car brakes fail do you buy a new car or fix the brakes. Go to court with the county as a group. They have lost on forced sewage hook up before. JUST SAY NO! The cities of Fairhope and Daphne spill raw sewage into the Bay and pollute more than septic systems ever could. Call ADEM and check out the spills.

The laws that WERE in the planning and zoning manual for requiring an individual to hook up to sewage had three main points:
The hook up had to be reasonable,available and border your property.
In many cases the county or cities were telling people they had to hook up to these sewer systems even though they did not meet these three main requirements.ie.
$10,000 is not reasonable for someone who makes $35-$40K a year.
In many cases the lines did not border the property at all.
The county got sued and they pulled the REGS.
Now they have companies that run lines and think they can make you hook up to it.
Since when does a public utility MAKE you use their service.
If you have a septic system you MUST challenge their ambiguous definition of failure. Failure is by design not because a part breaks or is antiquated. YOU CAN REPLACE IT!!
Remember, even though these people are using right-of-ways that belong to the county they are not answering to the public service commission and they should.
If they decide to go out of business you are left with a sewage system that doesn't work and nobody is required to pick it up.
The laws regulating these sewage companies need to be completely revamped and all sewage companies need to fall under public service commission instead of letting rogue enterprise dictate to and abuse the public.

I have to agree with you 100% we should all hire a lawyer and file a class action on this guy. This is hard times for everyone the unemployment is the hightest in 26 yrs. and now this too. Raises for everyone has been frozen gas is still over 2.50 a gallon. People are barely making ends meet, and now this !!!! TRY AND HELP PEOPLE NOT DIG DEEPER IN THEIR POCKETS.

He won't come to his meetings where he is the developer of a subvivision, so what makes one think he will see someone else - he sends Daniel Craven, his attorney, to all his meetings. I've been to BCSS, and can't find the man. I've tried to find him at one of his development companies - and can hardly find an address and phone number for those - now who looks like they're hiding???

We have problems people. This sewer rate thing is just one more. Personally, I've put myself on the "vote out all incumbents" bandwagon. Federal, state, local, democrat, republican, whatever. I will vote against every incumbent running for office. Maybe, if enough people do this, the politicos will get the message that they are working for and are answerable to us, the voters! "We the People" need to take this country back...soon.

I'm all for that. If they can't enact term limits then let's do it for them. How else are we going to get rid of the good old boys who have been holding office since their ancestors got off of the Mayflower and still consider it their Devine Right to rule the rest of us?
