My Point of view; He should be charged with DUI manslaughter and he should go to jail. The Families of both the survivor and of the victim should be entitled to Zero dollars in damages. Both, as far as we know, enter the car willingly and choose to take a chance with a drunk driver, so no damages should be paid by the drivers family.

Another classic case of Dumbassicide. We all know the routine you go out and get tore up from the floor up and then get in the car with another Moron Who is just as tore up as yourself and, Oh my bless you precious little soul, you done got yourself killed. Lets lay the blame somewhere instead of placing it solely on the people who got in the vehicle and that is where all responsibility should lay.

Agree with some of the other posters on here. If someone drives drunk, we don't allow them any excuses if they crash, kill someone etc. But if a drunken passanger makes a choice to get into a car with a drunk driver and they die, they are victims and the drunk drivers are evil people who snatched their lives away. Should the drunk driver get away with a slap on the wrist? No, but unless the driver in this case forced the passanger at gunpoint to get into the car, he made a choice as well. To get into the car with someone he knew had drinking. When you do that, you're making a choice as well, that you may not come home at the end of the night. That is not a victim.
