If he's under indictment in district court in Smith County and hasn't bonded out then he indeed is represented by an attorney. Myself and the rest of the county are paying for your son's representation already.

Sure it works. Smith County juries can't guarantee that a person will never commit another crime, but they can preclude that individuals opportunity to do so by giving the criminals actual pen sentences that keep them out of our neighborhoods.

Just wanted to ask the mom what happened to your son? I read most of the comments and it is to be expected drug charges 1st, 2nd,.... it has to be dealt with. Just remember THE LORD will never put on you what he will not see you through.

my son is still in smith county jail and is awaiting a jury trial because they are trying to give him 10 to 15 years for his 1st offense now and think that is a harsh sentence for someone who has never been in trouble before. He has been in there 6 months and i feel that he has learned his lesson and would never do this again but evidently smith county is trying to throw the book at him without giving him a second chance to learn from this experience. Smith county feels that all black young men are harden criminals and should go from the streets straight to prison without some type of reform. Not all young black men are thugs and losers. He made a mistake by trying to help someone in his family and didnt realize what he was getting into. Just pray for us ! some do learn their lesson and my son is one of them

I hear your anger, which is normal. There are so many people myself included that thought they had learned their lesson with just being in jail. Be thankful for your blessings in good and bad times. Your journey will not be easy, if he has to serve time you will serve it with him unfortunately. BUT its not forever its a journey and through the LORD you will triumph.

Firstly, I will pray for your son. I know how hard it is on a Mother of a child in Jail, especially for a first offense. This is my opinion of Smith County. It's all about Money and yes, they do like to make examples out of people. Secondly, Smith county is corrupt and I can't wait to move FROM Smith County. Yes, it is a nice place to raise a family but from Judges to Sheriff, its a bunch of hypocrites. Mothers against drunk driving being talked about by someone who steadily leaves from country clubs unable to even walk, much less drive. Lawyers who trade this case for a game of golf. It's okay for the "Law Makers" to leave Rick's on the Square toasted but if you get caught, you are gonna get the book thrown at you. Very very sad but we will all have to stand before God and give an account on the way we did our jobs and if we threw stones at "Criminals" while doing the exact same thing...well, I wouldn't want to be standing in their shoes. Good Luck with things. Believe me, I know the feeling all too well.

things are still the same, just awaiting jury trial. Hopefully, the lawyer i hired with Gods help will free him. i talk to often and he seems to be doing fine but ready to come home. The holidays are espeacially hard on him and me!I wouldn't wish this on no mother or loving parent. please talk to your children and watch who they are associated with. And most importantly, be a good example for your children because they look at you for guidence. thanks for all the prayer offers and prayers sent up. Stay Blessed!

My son was on probation for a juvenile theft charge. He got a DWI in smith county and was a "Example", was sentenced to 5 years. He was 18 when he went to the penn. He did 17 years on that 5 year sentence. He could not or would not stay out of trouble. If these kids are not hardcore criminals when they go in, they will be when they come out. We have had to disown our Son because of his lifestyle that he learned while locked up. He is now a leader of a gang who carry out hate crimes. It is only a matter of time before he goes back. From what I am told, when you get in there, you either chose a gang or die. They are all race related. Our Son was not raised to be a racist and we will not tolerate it. So we had to send him packin. I pray that the putcome is different with your child. But until the prison system can get control of these gangs (they are afraid of them) then nothing will change. The guards are very accomidating to the inmates out of fear. Fear for their own safety. They bring in guns, drugs, cash, or anything else the inmate wants. And if the "authority" is afraid of them, then the new kids dont stand a chance of rehabilitation.

He wasn't made an example of, he was punished. Probation is your second chance after you've already royally screwed up. He intentionally violated the judge's orders. You violate probation, you get maxed out. He drove a 2000lb death machine while drunk without a care in the world of every other motorist. Tough, but he's no victim. He is a criminal and got what he knew would be coming to him if he violated probation.

If your son got 5 years n a DWI than either it was a feloy DWI, meaning it was at least his third DWI, or when he decided to drive drunk he caused an accident and hurt or killed someone. That is the only way under Texas law he could get prison time for a DWI. Something seems fishy about your story.

It was a felony DWI. He thought he could run from them and get away with it. I never claimed he was a victim, I am sorry if it came off sounding that way. I do not condone anyone who drinks and drives. I am the one who called the police when he would not give us his keys. I agree that he did break the law and was truly deserving of being punished. My point was, that when they decide to "example" a criminal, they stand no chance of any rehabilitation. Weather it is my son or anyone elses. Once they hit the prison system it is over. We had to make the nearly impossible decision to never have any contact with our child again. The point was that I dont wish that on anyone...

sounds like he had a chance to rehabilitate himself when he was given probation but he decided not to use that chance.
