One mistake she shouldn’t have to give up her life for it… like I said lets put the shoe on the other foot, and see how many of you will be looking at things differently… I guarantee you all have a kid or family member that has had to deal with DWI and no it doesn’t make it right but it happens… Sounds like a lot of backpedaling to me. Your words were very telling. For you to say "I guarantee that you all have a kid or family member that has had to deal with DWI" is highly presumptuous. Maybe DWI is a common thing in your family and in your circles. But I've got news for you! There are many, many families who -- by the instilling of virtues and respect for the law -- have never dealt with it. And no, it is not a result of "luck", it is due to the clear distinguishing between right and wrong, and discipline (real consequences for bad behavior).

Let's get one thing straight......Vic Titus did a good job of clouding the actualy facts of the case....but the judges decision (not a jury) came down to the simple fact that the city attorney was totally unprepared for the case. By not having the one necessary witness there to testify, it did not allow the officers the chance to lay the foundation for the breath. The officer observed a violation, his observations led to tests, she failed the tests and was arrested. Plan and simple. Until the city gets a full time criminal attorney, these people will continue to get off on a variety of things.

From what I've heard about those close to this situation at Aztec High, Maestas was actually administering breathalyzer tests to the prom-attending students, if you can believe that, before she decided to hop in a car, sloshed, with a few friends and head to the Top Deck, and continue her drinking ways inside! How's that for hypocrisy: kids, don't drink, and we'll test you to make sure you aren't -- but I WILL REFUSE to cop's attempt to have me take a breathalyzer test! This seems to come up nearly every year around these here parts at prom time: drunken teachers, or in this case, an administrator who deserves demotion back into the teaching ranks (no, better yet, get rid of her b/c students don't deserve this anti-role model hypocrit) reliving their adolescence at potentially -- every other safe driver's expense. Luckily, the corpulent Ms. Maestas didn't run over any kiddies this time! Knowing the way this county and its judges, and school officials, handle such bad judgments, she WILL SOON BE PROMOTED TO PRINCIPAL! Woohoo, San Juan County, Drunken Teacher on Prom Night-USA! YeeeeeHawwww!! Hey Melissa: Real nice mug shot there too, if UGLY is a good thing!:(

On a side note, I'd be more worried about the "slightest degree" clause of the law which seems to be that if you have a B.A.C. below .08 and the officer fails you on a sobriety, you run a very serious risk of a DWI whether or not you were actually impaired as it comes down to a subjective jury call (as what judge would doubt the word of an officer)?
I've read some jury instructions lately that make it very hard NOT to find someone guilty, even with the burden of proof on the state.
