Here is a dumb question...if this is their third/fourth DWI WHY are they out of jail???? As a nurse, I get to pick up the remains of patients on a regular basis from people like this. The drunk drivers are rarely hurt, while the innocent fight for their lives. They are both very fortunate they did not kill someone. When is NM going to ACTUALLY cut down on this problem. I have been outside of the courtroom on more than one occasion and heard lawyers out in the hallways pleading with the officer to lighten or drop the charges because.."they have a job they will loose:", or they have a family to feed...blah blah blah... Where are these attorneys when the innocent have been killed? Kind of a heavy weight to carry when it is really easy to show drunk drivers that we really mean business, and first offence really DOES mean 28 days in jail...3x and the three strikes your out rule applies." This problem is absolutly ridiculous!!

My question would be why a person with a third/fourth DWI was even out of jail at this point?? As a nurse, I get to work with the left over remains from jerks like these on a daily basis. Ever notice the innocent get hurt while these big ninnies walk away mumbling stuff like " uh what happened...Im not drunk occifer!!". NM needs to start taking control over this. we have a 3 strkes and your out law, but I never hear of it being used. Why?? Maybe it is because our lovely lawyers like to meet outside the courtroom with the officers and plead their cases down because " they have a family they need to feed or my personal favorite...they have a job they might loose". What about the lives people loose? Wake up NM. This is just plain stupidity!!

The reason this keeps happening is the reason the whole United States is in the condition it is in. Criminals are NEVER punished, bleeding hearts, they can be rehabilitated people won't let the criminals face punishment!!! Always blame the gun, the booze, etc: Don't blame the Criminal attitude stinks! You play you PAY! Stop letting innocent people suffer because the system won't do the proper job!

Did you say Tod Gabehart (owner of KB Dillons) Tod? 4th Offence isnt that a felony? Daily Times I think you need to do some research into this story before you post it.
How does he keep his liquor license? 3 previous times he has been arrested for DWI? How has he kept it this long and why is that not news for the paper. You seem to love it when a FFD or FPD gets into trouble why not Tod? 4th DWI this is major news.
I do really hope phogan doesnt delete this post but am sure he will.

He owns his own bar? Truly?? So if he wants to get shizzlefaced, why doesn't he put a cot in KB Dillion's and pass out there instead of putting other lives in danger. If this is fact and he does own the place, I'm never eating there again. I refuse to put my hard earned money in the hands of a serial DWI offender so he can continue his "hobby".

I wondered if it was the same Gabehart too... maybe not.. Wonder how Vic Titus will get hem out of this one if it is him??

We could be barking up the wrong tree.. but if we aren't that's a fair point about the liquor license, doesn't anyone know if the behavior of the owner has an effect on the establishments license??

I am amazed that the Daily rag didnt make this a front page headline "KB Dillon's owner arrested for 4th DWI after running from police"
They would have done it for anyone else, especially if they were employed by COF.
Why to double sided reporting? Please answer this Daily Times.

Gabehart has a criminal record that goes way back, including a manslaughter charge. Lock him up before he kills someone else. Oh, and his wife works for our District Attorney, interesting.

The laws here are a joke. nothing ever happens to thes ones who drink and drive. My ex has four dui/dwi's, he's only ever gotten a slap on the wrist for it. The law enforcers such as the judges here are a joke as well. Their affraid to mead out the law for fear that they may not get re-elected or they may hurt someones feelings. If they would enforce the maximum sentence the first time maybe others would be discouraged from doing the same. I have no confidence in our judicial system.

So ow many DWI'S does it take before they do any real time. Or do they actually have to take the lives of innocent people before they will take it serious. Love NM DWI laws. And people wonder why we have the highest DWI rate in the USA.

Seriously, I have stood outside the courtroom on a couple of instances ( previous job required court appearances on a regular basis). I would here your above mentioned lawyer as well as several other upstanding lawyers plead a soft story to the police officer before going inside. It AMAZED me! Judge Carla Dial tried to put a stop to it by meeting with the SO and Sheriff dept saying she would do what the law would let her do but they had to actually MAKE IT INTO HER COURT ROOOM to work. Sheriff Melton made it perfectly clear if he heard of any of his officers playing this game, they would be suspended or fired. So there ARE judges here that want it to stop. Has to start with the police though and they need to say NO when approached by our upstanding lawyers of this lovely town.

does anyone realize how hard it is to be professional and take care of a patient who comes in with few cuts and scrapes, knowing that they just had their fourth DWI and killed their SECOND person in 5 years? It makes it very hard to jump up and run to that person with their pain meds without feeling a tiny bit pissed off. Ethical treatment says we have to do it, but it does not mean we have to do it with a great big smile on our faces. What i have done and what I have "wanted" to do are two very different things!

That is so VERY true. When the Kirtland cheerleader saga was a hot topic the Daily times took away the ability of readers to post their comments. When new discussion posts were started saying "isn't this censorship?" those threads were promptly deleted as well. This has obviously happened multple times, especially when the heat of public opinion is turned toward someone in power!! I find it totally amazing that a local newspaper, who should be standing up for free speech, promptly censors whatever is said when they or someone with money whines about what is being said. Perhaps we should consider the fact that the local rag only publishes what it wants to and the rest it attempts to sweep under the carpet when you consider buying a subscription!
