This young man just got out of prison for a hate crime in Oxford. He received six yrs.
Beating case goes to grand jury ---------- Suspects blame each other in Oxford attack BY STEVE KEMME The Cincinnati Enquirer OXFORD - Steve R. Cole and Jeffrey E. Eberle, both charged in the brutal beating of a Miami University student last month, accused each other of hitting the student in the head with an ax handle, a police detective testified Friday. But their two companions said Mr. Cole wielded the ax handle, said Oxford Police Detective Dennis Barter during a preliminary hearing in Butler County Area I Court. Mr. Cole and Mr. Eberle each admitted to punching and kicking Christopher Jason Kindinger in the head as he lay on the ground, said Detective Barter, who interviewed them after they were arrested. After hearing testimony from Oxford Police Officer Gregory Moore, Judge Patricia Oney ruled there was sufficient evidence to send the case to a Butler County grand jury. Mr. Cole, 18, of Oxford, and Mr. Eberle, 19, of Loveland, are charged with felonious assault. They are accused of yelling racial and anti-homosexual slurs during the attack. Both are being held at Butler County Jail. U.S. Attorney Sharon Zealey said Friday that she hasn't decided whether to file federal charges against Mr. Cole and Mr. Eberle. Doctors had to rebuild Mr. Kindinger's left cheekbone and eye socket. He is recovering in his New Boston, Ohio, home. The attack occurred about 3 a.m. Jan. 19, while Mr. Kindinger, 19, and his friend, Brad Waite, were walking on East Vine Street in Oxford. Detective Barter said Mr. Cole told him that he, Mr. Eberle and two other friends were cruising,''looking for someone to attack.'' Mr. Cole said Mr. Eberle struck Mr. Kindinger with the ax handle and that he kicked Mr. Kindinger eight to 10 times. Mr. Eberle said Mr. Cole swung at Mr. Waite with the ax handle and missed, and then hit Mr. Kindinger in the head, Detective Barter said. ''Mr. Eberle said he kicked and punched Mr. Kindinger in the head,'' he said.''Mr. Cole swung the ax handle at Mr. Kindinger when he was on the ground and missed, striking Mr. Eberle in the leg. That caused Mr. Eberle to stop kicking.'' Detective Barter said the driver of the car, Ryan Goodman, and another passenger, Jason Kelly, said Mr. Cole hit Mr. Kindinger with the ax handle. Holy Shit!!! Justice comes to those who wait, I suppose... Hard to believe I was brutally beaten by a murderer and live to tell about it... but what is there to say?

I thought that, in our country, it was prosecute, not persecute. For those of you who don't know, that means innocent until proven guilty, not guilty until proven innocent. |

Obviously someone made a mistake on releasing him.He is very sick to do the things he has done. But my relief comes from seeing him crying for his life when he had no reguard for your life Chris and for my dear friend Michael Fish. Justice will be served only when he is put to death after many many years on DEATH ROW waiting to die, while being haunted by images of what he has done. God Bless |

I absolutely agree!!! I went to the same high school during the same time that Jeff did. He never really had any regard for others and never took into consideration the consequences of his actions. To the victims and their family members that Jeff has so recklessly devastated, I sincerely regret the irreparable harm that he has done. |

Innocent until proven guilty. They both admitted to the hate crime, who really cares who used the handle and who didn't. THe fact that matters is they did a horrible thing and they deserve both to get punished equally. And when you admit to doing something like that, in my mind the trial is a waste of money, it should be nothing but sentencing.

I believe that we are innocent until proven guilty. The facts need to come out and all individuals involved need to be punished. Our system singles out one person and stops searching for what really happened. As in our several articles published lately, it does not matter if the person charged really did the deed rather it becomes a murder solved and people are locked innocent or guilty.

This is how our system works. There must be enough evidence to lock him up. The jury will decide his fate. Sounds like you know more than you are saying. Were you there when it happened? |

yes it does but come on does anybody deserve to die the way he did. He was a person, yes he did some things but thats not who he was. He was an average person like you and me just trying to make it the only way he knew how. He didn't deserve to die and he especially didn't deserve to die the way he did. If you would've known him and cared for him in the way that we did then you would want this motherfucker to fry to

Michael Fish is my 2nd cousin, by marriage. He most certainly didn't deserve what happened to him. It's a shame that people do such unbelievable things to other people. I really don't have words for what they did to him, I am still shocked when I think about it. They must pay the maximum, especially since they seem to have done something similar before. Thank God Chris survived his attack, too bad my cousin didn't. Peace & love to all of Mike's family & friends.

I have Michael's family in my prayers and I just want to say that what Jeff did was absolutely horrible. How can someone do this to another person? It was definitely pre meditated work and Jeff should fry for what he did. He doesn't have to worry about just that though, he should be worrying about the man upstairs after he gets the death penalty. Good luck with that I hope you fry for all of eternity. This is completely psychotic behavior and whoever helped him should fry with him.

What happened to Michael Fish is horrible. What everyone needs to remember is that we do have a justice system and you are innocent until proven guilty. Circumstances are not always how they appear, unless you were there when Fish died you can't say. How many times have we seen people released from jail from being wrongly accused and convicted?

With no DNA in this case how can we be sure who committed this murder. Can you be sure? How many drug dealers are involved in this case?

You don't need DNA. In fact a lot of cases are proven without DNA. Time line, receipts,video,and cell phone records, etc. They can even tell where you are when you make a cell call and all witness statements. The jury will decide. My prayers are with the family of Mike Fish. I'm sure you will get justice, even though it will never take away the pain.
