And after all that he gets no jail time. How about a review of his internal affairs file. This was not his first illegal act. Someone needs to review the cover up of his continous criminal actions. When an officer commits a crime, the victims report it to the police and then the police make it a matter of internal affairs. In doing so they cover it up becouse it is all confidential.

who the hell are you and what do you know about a trooper in iowa. it sounds like to me that you really don't know what you are talking about. I personnaly knowledge about the investgation and there was no other victims that came forward and there was no indication of any. I think that you should get your fact straight before you commit slander

I have made my statement. There have been other complaints and they were ignored. He deserves to serve time. He is a pedophile and a terrorist and a perjurer. He has had other problems and the "force" made them go away. A crime is a crime. If you committ a crime you should be charged. Internal affairs has helped cover up his other indiscetions as well. This was far from his first crime. Other officers who frankly are afraid of him and his families influence also know about his activities. He has no hesitation about physical violence and then lying about it. Becouse he carried a gun and was willing to use it did not make him god, more like Hitler. I know, I have personal knowledge. The dept was informed and just covered things up. If you are such a good and honest investigator pull his internal affairs file. Read between the lines. Nobody would do anything about him until it was on tape and they were forced to by sheer public opinion. If this could have been kept quiet it would have been just like the other stuff. He recieved the absolute least they could give him. His crime should have gotten him manditory jail time. He confessed on tape and the state had a witness. You don't plea bargan that away. Not ethically anyway. I believe a polygraph can be required of all troopers yet it wasn't. He is a pervert and an embarassment and they quickly hid as much as they could and bargained the rest away. People don't come forward becouse there is no justice when dealing with some people with influence. Been burned..... |

You say you have knowledge of this case; Salt Lake City is a far ways from Iowa. You are making statements that you can't back up. I've listened to the tape that you said that he confessed in. All that was released to the media was bits and pieces. If you hear the tape from start to finish you would see how week the state’s case was. The reason that the state made a deal was because they were scared that they were going to lose the case in trial. He had a very good attorney. The attorney caught the lead investigator lying in his deposition. Not good for the state's case. They conducted a poor investigation from the start. They failed to investigate the victim’s family and look into the real source of the abuse.
As far as internal affairs covering up other things, you are getting your information from someone who hasn’t a clue. This officer’s file is as clean as they come. If all the files in internal affairs looked like this ones, they wouldn’t have a need for the unit. And as for you references to Hitler and others I think that you need to seek a good psychologist to help you with your many mental issues. |

Investigator - I am a little confused….you mention that “they failed to investigate the victim’s family and look into the real source of the abuse.” I am puzzled at the relevance of that statement. Did not his attorney say that “I think it was in his best interest not to go to trial” and that I “negotiated many days for this plea and recommended highly that he take it” and that Kluender did not dispute the child’s statements as reflected in the Minutes Of Testimony? Is not a crime a crime? Seems to me like he did something wrong. If you have knowledge of the case, would you not agree? I question if you listened to any tapes. Victim – You mention previous complaints and his families influence. That makes me wonder what type of information was passed along to his department and from what angle would his family have influence? These types of crimes are rather secretive, so how would other officers know if he had been committing these type of crimes (or are they other types of crimes)

This is interesting. Being a officer is like belonging to a serority. It doesn't take long before everybody else knows what you did and to who. His case file was kept clean. We all know what he was like. We all know he was protected and got a sweet deal. How does a police officer afford Kutmus as a lawyer anyway? He is a very exspensive mouth piece who has no problem "doing what it takes". I heard the tape. And I know what he was like. The devil in uniform, you didn't dare corect him or cross him (family had to much power-as evidenced by the sentence). You don't have to work with him very long to find out just which type of officer he is. Internal affairs had the opportunity to dismiss and or prosecute him on more than one occasion and they didn't. He is and was abusive and had no problem violating the law whenever he wished. Just becouse he was never prosecuted for his other dispicable exsploits doesn't mean he didn't do them. And the girl did not want to testify becouse she was scared and frankly had a right to be so. Kluender had a history of threatining anyone who got in his way. He was a police officer and carried a gun and no-one believed the girl until he confessed on tape (even though there were other complaints that were white washed away. Kluender is not the only one who commited a crime here. There was ample oportunity to be rid of this criminal in uniform. You do understand about corruption don't you? This "officer" was bad enough that his comrads were scared to oppose him. First hand knowledge here. And Internal Affairs and the dept knew all about it, they are the ones who helped clean up behind him. That is why it is not on his official record!!! A judge even cleaned up at "least" one transcript and made something go away. A badge does not make you honest. A polygraph was never given. He could have been forced to take one at anytime and the scope could have been broadened to encompass anything the department wanted (ie: other crimes). And the department threw that opprtunity away becouse THEY KNEW about his other crimes. Was there and saw it. He needed and diserved prison and several other officials needed fired and prosecuted for participating in this miscarage of justice. First hand knowledge here. Not second, not third, FIRST!

just looking through this blog and i see that everyone has viewed or heard documents/tapes. I have not. the problem here is a crime is a crime. someone else in denison, one of kluenders high school buddies, got in trouble at the same time for a similar crime. Where is he today? it appears that the legal system is not fair, it really does matter who you are in Crawford county! it is in the sheriff department, the police department, the county attorneys office, etc.

First Hand Knowledge, If I were you I guess that I would be fearful that the defendant doesn't go out and hire another expensive lawyer, and go after you for slander. You and your first hand knowledge are full of BULL SHIT!!!!! If his family had all this power that you say they have, then how did this even get to the courts???? I really don't think you have a clue about the former Trooper. I think that you have a real good imagination and fill in a lot of blanks about this case using it. |

Bistander – Sounds like you also know something, but why not be blunt about what it is? Investigator – You are very defensive of this guy, but yet you do not address anything I mention, why? Sounds to me that this high price attorney was scared if a plea was not taken, he would be in trouble. First Hand Knowledge – still interested in what angle his family had influence.

You can say what you want about the former Trooper, but the theory of a cover up is crap! I agree that if he committed a crime he should pay, but to make suggestions that it was covered up is rediculous. I have NO knowledge of the case, but I do have knowledge of law enforcement and how the criminal justice process works! It sometimes takes alot of DIRECT EVIDENCE to prove a class BEYOND A RESEASONABLE DOUBT. This is not civil court where is it just a perponderence of evidence. If the State didn't think they had a strong case, it may have been neccesary to plea bargin to salvage some form of punishment. And to think his co-workers or IA would cover it up, you are fooling yourself.

I have no first hand knowledge, however a crime is a crime. I have served jail time for a far less sinister thing. If there were any justice in the world this man would be hanging by his genitalia. You don't think corruption exists in law enforcement...in droves? You're crazy, furthermore you are wrong. Anyone telling you differently has a law enforcement background or some douchebag relative at the local donut shop passing for the town precinct. karma is fair. Its coming back around. The piece of excrement will get his the spiritual way.

investigator,i sure hope your spelling was correct on all your forms and official paperwork..first thing i was taught on the job was to take my time and spell things correct. id love for you to identify yourself..badge number and all..i doubt you investigate more than a computer screen with all the ranting and raving you do. if hes guilty IA will decide.

Don't I know it. Someone accused someone close to me of harassing her and it didn't happen. BUt, the cops and the county attorney treated him as guilty anyway. the so called victim made it all up or she was pissed because this close person told her no when she wanted to start a relationship with him. She got pissed, and made up this other crap. 50 dollars cost, a mental eval, 50 hours commmunity service and one year unsupervised probation, all this for nothing but someones feelings were hurt. boohoo. don't try going after a married person. Both of us are basically nobody in this town since neither of us have lived here our whole lives. it really does matter who you are and who you know whether or not you get real justice in this county. |
