(((((((("I was scared for my teammates. What would happen to them?" seventh-grader Matthew Chacon said Friday. His mother, Sylvia Chacon, was driving behind the bus when she says she saw the truck trying to force the bus to pull over as it approached the Trowbridge Drive exit on U.S. 54.
"I was furious. I was upset," Sylvia Chacon said.
Eventually, the school bus and the truck pulled over on the side of the freeway. Sylvia Chacon , who also stopped behind the bus, said a man who was wearing street clothes stepped out of the truck, flashed an official-looking badge at the bus driver and boarded the bus.
"We're all surprised, and then he's all like,'Who threw (expletive) at my car?'" said Matthew, who did not believe anyone was throwing anything out the school bus leading up to the confrontation.
Sylvia Chacon said she began fearing for the children on board. She got out of her own car and got the man to leave after threatening to call authorities. "You don't know what could have happened. If he was having a bad day ... what could he have done to the children?" Chacon said. As it turns out, the man is an officer with Customs and Border Protection, according to El Paso Independent School District officials. CBP said it is conducting an internal investigation on the matter and did not name the officer involved. "I want his badge taken from him and I want him to be put in jail," Sylvia Chacon said.
She was also upset because she believes the coaches could have done more to protect the children. "Instead of the coaches backing up the children, they also started yelling at the children. I don't want to see them coach again")))))
I read the story and either Channel 7 KVIA left out something in the story or the school district failed to inform KVIA there were on board the bus. It does not make any difference if they had been because it was the out of control CBP officer who created the problem and forced his way on to the bus with his bag in hand. All he should have done is gotten the bus number and contacted the district police of the incident. It was a poor decision on his part. The bus driver had not choice of pulling over. If there were coaches on board they could not have done anything had the CBP officer had his weapon on his person or in hand.
The CPB officer needs some unpaid time off and stress management time ordered.

He is a federal officer and is charged with doing federal crimes and only when a felony is committed can he/she stop the criminal activity in progress. As there was no damage to his vehicle the crime is a class "C" misdemeanor. He had no authority to enforce the law. He has the duty to report the problem to the proper authority (either the EPPD or the EPISD). He has no authority to detains or the children.

Depending on what was thrown at his vehicle it could have been a felony. If anything had hit his vehicle and caused an accident that would have been assault with a deadly weapon. I have a really good idea. In order to prevent an LEO from having to take this action how about we control the individuals on the bus? I nor anyone else here can say what happened but I am fairly sure that the LEO would not have done this had he not been attacked. The throwing of an item from a moving vehicle at another moving vehicle at freeway speeds is a dangerous attack.

I wonder if the woman that is complaining bothered to ask the coaches why they were yelling at the kids on the bus, could it be the coaches were aware that someone on the bus actually threw something out of the window? It seems to me the woman has a problem with LEO's. I live up the street from an elementary school and I can tell you half the buses that drive by certainly don't look like the driver and chapperone are in control, the kids are screaming out the window's at drivers and pedestrians that are unfortunately in the vicinity. Of course pobricito, they're good kids that would'nt do anything like that. Maybe she should do some investigating before accusing people.

It didn't damage his truck and didn't enter his car therefor it is a misdemeanor. He cannot file any charges as he did not see who actually tossed the item from the bus. His behavior was bad and the CBP Supervisors will end up suspending him for several days.

You may be right about the supervisors as they are mostly controlled by PC. Based on what you said here that guy that threw a bottle at the cops and was shot must have been a bad shooting because it didn't hit the cops. Sorry it doesn't work if a projectile is thrown at an LEO it is assault.

And the LEO as you put it, has to be recognizable as a LEO in uniform or his badge has to be out and displayed and he has to say he was a police officer before the offense took place. Even Undercover cops when they being a pursuit make sure their credentials are out in front so the crook can see it. THE ADA would never take a case like this as an assault on an LEO. He was off duty and in civilian clothes. His Identification was in a badge holder in his jacket or pants pocket and not visible to the public. He will be lucky to just have a long suspension depending on his history of disciplinary actions taken previous to the incident.

So excatly how was he supposed to ID himself as an LEO when he was being assaulted at highway speeds? Do you have any idea what a little thing like a penny can do to a vehicle at 70 MPH? Talk to some bikers sometime and find out what they do to idiots that try to run them off the road using nothing more than a handfull of pennies or a few marbles. I understandf what you are saying but that does not change the fact that throwing items at other vehicles at freeway speeds is extremely dangerous. Remember also that LEOs are required to respond on or off duty if they witness a threat to public safety. Should an LEO ignore someone being assaulted because he is off duty and not in uniform? I wouldn't think so. I am sorry I tend to agree with much of what you post but in this instance I think we are jumping to persecute the LEO when it is evident that none of us know the entire story. The woman that was doing all the complaining obviously didn't know what she was talking about and was playing mother bear protecting her cubs. Based on the fact that the coaches were, as she put it, yelling at the kids as well to me is a fair indicator that these, "Kids" were not so innocent. I will trust in the CBP to investigate this and make the appropriate decision but until that time he is to me at least innocent until proven guilty.

I was an LEO. His behavior was very stupid and dangerous. He was in his POV and he was off-duty. There are other ways of handling this matter and he failed miserably. There was no damage as it did not hit his vehicle. He could have caused a major accident. There were other witnesses to the incident other than the over-zealous CPB officer. There were parents following the bus.

As to the parents I would take enything they said with a very big grain of salt as they are not exactly unbiased. As was demonstrated by the woman that was complaining.

He got cited by the school police for interfering with transportation which can run him a $500.00 fine. If he does not show up to court the Justice of the peace will issue a $200.00 Failure to appear warrant. HE has been identified and place on administrative leave until the incident is fully investigated by the CBP internal affairs unit. What he did was stupid and dangerous.
