Hi Eileen.
1. You can't get another Judge in MA - even if the Judge is in fact highly prejudiced against you.

You can ask him to recluse himself. He then has to go into his chambers and perform what is essentially a "self-test". If he decides he doesn't need to remove himself from your case - he stays, your stuck.

If he does remove himself – you may get one of the other Judges who likes to follow in the footsteps of the original Judge – you’re stuck again.

2. History with this Judge indicates he is highly prejudiced usually against one or the other party – but not due to gender.

This Judge tends to take sides with the attorney who pushes the process the strongest, and who is most skilled at character bashing/defamation.

If the character bashing, process focused attorney is truly skilled – all sight of your children, their needs, the ability of the father to provide, the language and intent of child support guidelines will be ignored. Evidence too will be ignored.

3. The letter to Governor and officials is good – but will not be enough. You must also file a formal complaint with the Commission on Judicial Reform, you can try to register a complaint with the Board of Bar Overseers – they don’t take complaints readily.

Keep copies of your complaints and follow up to be sure they received them. Follow up a month later to learn status.

Unfortunately you have little hope with this Judge, and almost no attorney who is in their right mind will truly be able to help you succeed in attaining justice. If Judge Livingstone doesn’t like you, you will certainly feel the pain of financial ruin, the inability to have your children provided for as required by law will quickly become (if it hasn’t already) irrelevant.

FYI – Mark your calendar. Judge Livingstone’s misconduct charges will be heard in public on May 19th. Details have yet to be published, but the CJC website has to post a press release eventually. For the latest article see this week’s issue of Lawyer’s Weekly.

So, if he resigns before then, or is asked to resign after the hearing you and so many others may have hope that a truly unbiased Judge may replace him. The new Judge will have quite a busy schedule with everyone trying to be heard – this time for real, with respect, and with an eye for the best interest of the children.

I apologize to have to differ with your opinion. Judge Lisa Roberts who is taking over seveal of Livingstones cases is following EXACTLY what he started and in some instances even worse. TRUST ME... She has demonstrated already discrimination, and ignoring the facts as well as refusing to hear emergency motions. She could and very well be even more unfair that Livingstone if that is humanly possible.

Judge Lisa Roberts has taken over some of Judge Livingstones cases and as expected does nothing that is in the best interest of children, she also had taped recordings of a case she presided over altered, go to google and type in Judge Lisa A. Roberts mass., that is a crime , a felony I believe , but because she is a Judge in Mass., she is immune, Is anyone ever going to do anyhting about these Judges that commit crimes and worse ruin childrens lives.

I had one of the worst experiences with injustice EVER at the hands of Judge Lisa A. Roberts (who graduated from Manhattanville College?!?). As a result of her bias and complete disregard for the facts of the case and the LAW, which I believe she is sworn to uphold, I became involved in a year-long outrageously-expensive appeal. The good news is that the appeals court overturned her decision out-of-hand (which, according to my attorney they NEVER do - proving that her decision was baseless to begin with). She is a nasty, nasty woman who should not be sitting on the bench LET ALONE making decisions about families and their lives.

Don't work. Give up. Most judges WILL excuse themselves when requested to do so. HOWEVER, the next judge WILL follow what the past judge already did. What you want is a CHANGE OF VENUE. THAT NO ONE EVER GETS. That is the ONLY time you have a shot at being treated fairly. Canton Probate Court is known to be the MOST FAIR to ALL PARTIES. Alot of people just gripe because they don't feel they are getting what they want, then again, there are also alot that are getting the royal screw. Can't fight the system. The only matter in your favor if you are on the losing end is eventually your child(ren) will be old enough to be heard in court. Then it's a whole new ball game.

And did you forget to mention who paid for all your expenses? NOT YOU. Your mouth and actions are your two worst enemies. Your three minor kids are ashamed of you and your sick behavior. You KICKED A GIFT HORSE IN THE MOUTH.

You probably even had the gaul to go to your EX father inlaws wake and funeral. Sadest part is the dumb rass that you divorced you would still take your sorry act back. He is just as sick as you. Neither of you deserve those kids. Why don't you just have your gay uncle and his money fight for custody? HAAAAAAAAAAAAAAAAAAA

Whoa! We've got some haters here! I'm not sure who these comments are directed at, but it seems that I've been confused with someone else. I've got two kids; my ex father-in-law is alive and kicking; and all of my uncles are heterosexual. Oh, and I paid for all of my court expenses. I can stand on my own two feet.

Why do you think judges wont let children testify? They are all afraid of the truth, the probate system ,particularly in Plymouth County is a cespool of currupt political hacks who couldnt make it on there own or in private practice, these currupt hack Judges put on there black robes and think they are God.

i am wondering if anyone else has any thoughts on judge roberts. i lost custody of my 3 children with judge roberts to their fathers in 2007 due to my prescription med use. sindce then, i regained custody of my oldest from her dad( and of course dumped my drugpushing doc and have been free of meds for 20 months)my problem is that the cf of my younger children has taken his abuse of us to new highs with his custodial powers. i live in the home with my kids and him and have since nov 2007, 5 mos after he was given custody, except for those 5 mos(he also played rest.order games to add to his control, has since expired but i am threatened constantly with another)I have and do take care of my kids day and night- i have my own place 5mins from here but i am never there- i wake up here get my kids ready and take them to school, then i go to school then back here to get my kids off bus, homework dinner etc. and so on. cf is an an abusive alcoholic, he drinks daily-not here at bars-and pushes, hits and spits at me. he has also choked my young son, spit at him kicked him in the back, pushed him to ground etc. i cannot do anything legally to protect them or myself. dss is out of picture for past year and thats where i want them. cf emotionally tortures my kids with things like watch out or i'll have your mother arrested, or doi'll kick your mother out and shell never come back. he drives drunk with them in the car on the 2 nights i work, and has even brought them to eat and had them sit at the bar with him. he makes 80,000 a year yet i buy most food every day in the home. he wont buy them clothes etc. the list goes on.cf has a vdomestic violence record with me and with ex. he also has been arrested for drug posses. twice and drunkdriving twice, all just prior to being given custody by roberts. legal services wont help noncustodial parents and i cannot hire lawyer. i need to ask judge roberts on my own to restore my custody so we can be free of cf and his abuse but i am afraid where i have not been in front of roberts in this case for 2 years, my claims may result in my kids being given to dss. roberts has seen me as i was given custody of my older child last summer, she knows i am free of meds etc. but that was not in this case. both my kids have therapists who are aware of cf alcoholism and wouold support them being out of home. i am very scared for my kids but feel i must do something soon b4 the end up hurt or worse in a car or otherwise . any thought or experience any one??? much appreciated

Judge Lisa Roberts is a ccccccccccccccccccrooked ,currupt piece of garbage, she lives by parental alienation, potrays herself as beeter than everybody in court, she is a SERVANT to the taxpayers of Mass., hopefully she will go the same way as ex Judge Livingstone, shame on you Judge Roberts ,you are an abuser of children and a disgrace to your profession.

What was the nature of your case that was appealed ?

I have a pending case with Roberts, formerly with Livingston, and she has already indicated a prejudice against me.

has anyone had any dealing with judge ordonez of canton probate court i have found her to be unreasonable law breaking judge

Judge Ordonez is the most unreasonable unlawful judge I have ever been in front of. I plan on starting a petition to have her removed from the bendch. Many men do not get a fair shake when it comes to thid judge and if she doesn't like you,man or woman,she will rule against you even if it is against the law or against guidelines. The difference is I will file an appeal and if I do not get resolution there, I will contact the Governer and Attorney General. Something needs to be done. She is usually siding with women and is very prejudice against men. Yet this woman is from what I have heard "married to a woman". She wouldn't like it if someone discriminated against her and her gay rights,yet she is so quick to throw men in jail when they are only a month behind in support or rule against them from the start by showing she is prejudice. Good thing that I have an attorney that will automatically appeal her unfair rulings. I will push this to the Supreme Court if needed...

Her rulings are not fair and by the book,yet none of Norfolks are. Norfolk should be held on crimianl charges for not ruling within the guidelines. Our courts in Massachusetts give the judges too much power. Maybe contacting Scott Brown would help as well for guidance on how to get her out of office.

Both of these judges are degenerates, Roberts I suspect molested as a child, and Steinberg the biggest pedophile and lover of little men you will ever see. Nevertheless, Plymouth Probate is a circus, and we are there for their entertainment. The Massachusetts Commission on Judicial Conduct is a patsey group; and an investigated complaint will get you in trouble with the judge. Commission does not have a track record of dishing out consequences for judicial misconduct. So, if you file a complaint and if it is investigate (if they go through the motions); you better be prepared. because the judge will come after you with a vengence. I am talking facts! But, use the Commission that is whatit is there for judicial misconduct. I the tough thing they have done was take out a judge for office letterhead for a personal matter; (we all know that was political). But, check out the website, and fight your fight to protect whoever.
