Mr. Barry maybe your client (a.k.a., "the "computer wizard") should have his parents explain to him the issues associated with not paying attention in class. As far as callinig it "assault and battery"?, I think maybe you should find another way to pay the bill for all of your TV advertising. The issue that seems to be of even greater concern to me that public service jobs are lately not what they are cracked up to be... Police being sued for DOING THEIR JOB!, now teachers will be subjected to the arogance of the minor student. What they AND most legal advisers need is a little RESPECT for our public servants.
"Many of us have fallen asleep in class and had the teacher wake us up. But what happened here was more in the nature of an assault and battery," he said. "My client is an extraordinarily bright young man. He's a computer wizard who works late into the night, and that's probably why he fell asleep."

Is this for real....I bet you his ipod is what caused the damage to his eardrum! How much is this going to cost the city of Danbury as they will probably have to settle as it will cost more to fight it.

teacher's hand slamming down on the sleeping scholar's desk...SCHOLAR??????????

hearing loss, may be permanent. REALLY?

We should sue the kid for falling asleep in class and wasting our taxpayer dollars. This case shouldn't even make it to court and shouldn't be allowed to proceed.

Uh, he's 15? I don't want to hear about how hard he works on his "computer wizardry" BS. His job is SCHOOL! If he wants to fall asleep, tell him to wait until he's hungover and in COLLEGE math!

This is the dumbest thing ive ever heard of in my life,your gonna sue because the teacher slammed your desk? This wont make it in court because she didnt physically touch him, and theres no evidence to support his claim that she slammed a desk. Get outta here

Just once, I wish a municipality would stand and fight. They all fold and make a settlement because it is cheaper to do so than go to court.(Newtown and the illegal paiter who put the ladder against the wires)

This is so absurd. Alan Barry you are no lawyer. You are a disgrace. The family of junior, the computer wiz scholar should be held responsible for ALL COSTS incurred by the city to fight this frivilous lawsuit. Perhaps, parenting skills and a reasonable bed time need to be explored instead of $eeing dollar $ign$

Being a parent of Teenage Computer Gamers and I-Pod listeners. I am constantly yelling at my kids to turn down the volume. It is a proven fact that our youth today are suffering hearing loss do to the headsets they are wearing and misusing. So the question is, is his hearing loss really from the wake up call? I highly doubt it!

All of today's comments are right on track -- Perhaps the teacher should sue because he/she hurt his/her hand slapping it on the desk -- the student's fault because he was asleep and had to be awakened. Just as ridiculous.
