Fascinatingly, DA Richard Smothermon fought and won for the suppression of this evidence during the trial of Kelsey's mother, Raye Dawn; sadly only one of the virtually countless mishandlings of Kelsey's case.

Shortly after being charged, Michael Porter began to correspond with Kathie Briggs and her daughters Shirica Howard and Jeanna Fowler in a series of emails that began in December, 2005 and lasted for the first two months of 2006. The alleged conspirators exchanged phone numbers and even met in secret to discuss the case and the evidence that could be mounted against Kelsey's mother and her family.
Kathie Briggs didn't hide want she was looking for in her emails. She took the time to meet with the person arrested for the murder of her granddaughter. Kathie even mentioned seeking charges against Gayla Smith, Kelsey's maternal grandmother, who was never suspected of anything. This shows how blind the hatred had become:

"First of all, I want Raye Dawn in jail and I want her charged with murder." Kathie Briggs to Porter 1/24/06

Michael Porter never went to trial for Murder and Sexual Assault. DA, Richard Smothermon gave him a plea agreement with the amended charge of Enabling Child Abuse, then used his testimony in a trial against Kelsey's mother. Smothermon has since moved Porter out of state to serve his time and his whereabouts are kept hidden "for his protection" according to a spokesman for the Oklahoma Department of Corrections. Kelsey's mother, Raye Dawn, was found guilty of Enabling Child Abuse, despite the lack of any evidence showing her knowledge of Porter having laid a hand on Kelsey prior to her death. The DA released information before Porter's trial regarding their interview with a school counselor.

She lobbied to enroll Kelsey in a "play therapy" program in an effort to determine if anything outside of a medical condition was happening to her daughter. Kelsey's mother received authorization for that program in the mail the day Kelsey died.

Despite the lack of any evidence showing Kelsey's mother having had warning of such a vicious attack,

a jury convicted her on the basis of Kelsey's death

. The DA asked the jury to find her guilty solely on contested evidence and the fact that Kelsey's step-father committed the act.

Raye Dawn is now appealing a 27 year sentence for a deed she did not commit and no evidence shows she allowed.

Without a cause identified Kelsey was removed from the guardianship of her paternal grandmother (Kathie Briggs) on May 3rd and taken into DHS custody to be placed in a foster home. Kelsey was placed by DHS in the home of Gayla Smith (Kelsey's maternal grandmother) where she remained for a month and a half from May 4th until June 15th. During this time visitation for her paternal grandparents (Kathie & Royce Briggs), her mother (Raye Dawn Smith) and her step-mother at the time (Ashley Briggs/ Lytle) were scheduled at DHS offices. Kelsey's father (Lance Briggs) was out of state during this time and according to DHS visitation logs her step-father (Michael Porter) had one in-person visit with Kelsey during these six weeks.These visits were Kelsey's only in-person contact with these people while she was in foster care.

The visits took place at DHS offices in designated visitation rooms where participants could be observed through one-way glass. Observation consisted of one or two DHS aide workers at any given time. These aide workers would then write notes on what they observed throughout the visit. This is our glimpse of Kelsey's interaction with these people while on a level field. This is where we see through the eyes of a trained DHS worker unconnected to either side of the custody battle.

The first scheduled visit after Kelsey was taken into DHS custody on May 3rd was with her paternal grandmother on May 6th. According to the log the first thing Kelsey did was "yell at GM (grandma)."

What follows over the next many weeks remains consistent with few variations. Kelsey; she reacted the way she felt.

On one visit Kelsey "told her Mom that Daddy Mike hurt her head." At the time of the visit, May 18th, it had been more than 16 days since Kelsey's last contact with Michael Porter. The aide noted it and Kelsey's mother, Raye Dawn, spoke with DHS regarding Kelsey's statement. The very next day Kelsey had two scheduled visits: first with her grandparents, Kathie & Royce Briggs, and the second to follow immediately after with her mother and Michael Porter (Porter's first since Kelsey went into DHS custody). When the aide went to retrieve Kelsey from her visit with the Briggs, Kathie claimed "when Kelsey saw Mike she crawled up on her lap and said she did not want to see him." Yet, when the aide "carried Kelsey into the room she was happy to see Mom and Mike." "At no time did Kelsey show any fear of Mike." Two weeks later in a visit with Kathie they "were sitting on the couch talking about their feet when aide observed Kelsey saying Daddy Mike hurt my feet" yet Kathie "did not comment on this." Kelsey mentions Mike where the aide worker can hear her only twice (once to her mother and once to Kathie) but only the mother acknowledges it. Who exactly was and was not looking out for Kelsey?

Raye Dawn allowed her daily life to be an open book to DHS. Even in testimony DHS stated that she was "completely cooperative" and that she did "everything that was asked of her."

There is no hope for Sue Cyr, and her sick fixation on Raye Dawn Smith. Her children have suffered repeated abuse throughout their lives. And this is the failure of the DHS for sending back those eight innocent souls who were sent back to her dangerous care.
