In March 2008, the Copperas Cove city council ousted the mayor, and apparently, on the advice of their $140,000 per year lawyer, they declared that they would hold the mayoral election on November 4, 2008. Then in July, the city’s alternate legal department, a newspaper that cost them a grand total of fifty cents, informed them that they were in violation of the State of Texas Constitution. They agreed that there was a problem. So to correct this situation, they decided to hold the election on November 4, 2008.

Sounds like they took corrective measure once it was determined there was a problem. Seems to me you can never know it all and when you find out there is a problem you do what you can to correct it. Sounds to me like their city attorney is the main problem here - too many mistakes far too often.

Solve this problem soon please for the sake of this city. Surrounding towns must be laughing at us by now. Actually Peterson, it sounds more like government as usual. Do the same thing that got you into trouble and call it a solution. The epitomy of arrogance. There was no way we could of gotten it done within the 120 days,it take a minimum of 62 days to get and election done. So therefore we are within 120 days of a general election so we can schedule it for that date 4th of Nov saving the tax payers (that would be you always complaining about spending to much money) 10,000 dollars of unbudgeted money. I am sorry if this date does not work for you but it is the date that is set for now. My mother always told me do not worry what people around you are doing if they are laughing let them laugh as long as your doing the right thing it really does not matter and I feel we are doing the right thing. Oh by the way which one of you is going to run for council I keep asking that question and you keep side stepping the answer. I think I have heard that from you before just answer the question?????? nothappyinCove wrote: corrective measure????? You could always use those now famous unencumbered funds. There is no shortage of money to spend on personal vendetta witch hunts, put it to use to help fix this city. Reeves as the appointed mayor is not working out too well. I personally don't have a problem with the date. I have a problem with a small group of people pissing on the state's constitution and not taking responsibility for their actions or inaction. Why is no one being held accountable for this failing? Oh right, the good ole boy system.

See your thinknig is that we intented not to follow the rule! The reality is that we really were given bad advise from the start by TML and did not know the constitution had different rules for cities with longer term lenghts. When we found out we fixed it as quickly as possible. I know you do not beleive that answer but there is nothing I can do to change it, it is what happen and there is no going back. We missed it and now the best we can do is have the election on the 4th and you can vote out of office who you will then. I am not worried about being voted out of office if it happens it happens and I still have a life after this is over. I may not be the kind of or the best council person there is and I will make mistakes but at least I am willing to try and doing the best I can. Until voted out of office I will conyinue to do my home work and try and do what is best for our community!! Geddy_Lee wrote: You could always use those now famous unencumbered funds. Bad advice from the TML?? While this may be true, Mark, the bottom line is that we have an overpaid attorney who obviously doesn't know much about municipal law.

I think that you have no clue on what unencumbered funds are. It might be useful to find out what they are first before talking about them. Just a friendly bit of advice.
