I would if I knew any of the teachers but I don't. I am not from Adair County. I just heard through the grapevine that a lady named Rosie from somerset was selling fake bags in and and around the South Central region. Why would she be selling them out in the open if she knew she could be caught? I am legetimate and trying to find out how to get in touch with her. I would appreciate the information. I am not trying to get anyone in trouble.

First of all is there even a "Rosie" that exists? If so, she sure is scarce and no one seems to know her. Second of all, why would anyone post information such as that on a public forum?
As for the difference - designer purses are VERY expensive - Louis purses can easily run well over 1000.00 - and no there is not enough difference that the normal person can distinguish. Furthermore, some of the sales people in the designer stores cannot tell the difference. You can check out ebay and see posts that give you clues as to how to spot a fake purse if you want that information. But beware, there are many fake purses sold on ebay and other auctions as well. Why not end this discussion now? |

Oh Yea Rosie exists and she is going to caught and prosecuted to the fullest limit of the law along with anyone who purchases a bag from her. She has been around for years and every person caught is one less person infringing on the right to use a label that does not belong to them to promote their own financial gain. She is under investigation. That is a felony offense punishable by up to 20 years in prison. |

You speak with such certainty...maybe you need to review the actual KRS (that would be Kentucky Revised Statue) on this issue...it's pasted in part below...You will see that the worst case is a Class D misdemeanor - punishable up to 5 yrs - not 20.
365.241 Counterfeiting intellectual property -- Penalties -- Disposition of property. (1) As used in this section: (a) "Counterfeit mark" means: 1. Any unauthorized reproduction or copy of intellectual property; or 2. Intellectual property knowingly affixed to any item without the authority of the owner of the intellectual property. (b) "Intellectual property" means any trademark, service mark, trade name, label, term, device, design, or word adopted or used by a person to identify the person's goods or services. (c) "Person" includes, in addition to its meaning under KRS 446.010, any association, organization, or entity amenable to suit in a court of law. (d) "Retail value" means the counterfeiter's regular selling price for the item or service bearing or identified by the counterfeit mark. In the case of items bearing a counterfeit mark which are components of a finished product, the retail value shall be the counterfeiter's regular selling price of the finished product on or in which the component would be utilized. (2) Any person who willfully manufactures, uses, displays, advertises, distributes, offers for sale, sells, or possesses with intent to sell or distribute any item or service that the person knows bears or is identified by a counterfeit mark shall be guilty of counterfeiting. (3) A person having possession, custody, or control of more than twenty-five (25) items that the person knows bear or are identified by a counterfeit mark shall be presumed to possess the items with the intent to sell or distribute. (4) Any person who violates the provisions of this section shall be guilty of a Class A misdemeanor, except where the person has been previously convicted of a violation of this section or the violation involves more than one hundred (100) items bearing a counterfeit mark or the total retail value of all items bearing, or services identified by, a counterfeit mark is more than one thousand dollars ($1,000), in which case the person shall be guilty of a Class D felony. Unless reduced by the court for extenuating circumstances and notwithstanding KRS Chapter 534, upon conviction the offender shall, in addition to any other allowable disposition, be fined an amount equal to the greater of: (a) Three (3) times the retail value of the items bearing, or services identified by, the counterfeit mark; (b) Double the amount of the defendant's gain from commission of the offense; or (c) As otherwise allowed in KRS Chapter 534 for felonies and misdemeanors. (5) For purposes of this section, the quantity or retail value of items or services shall include the aggregate quantity or retail value of all items bearing, or services identified by, every counterfeit mark the defendant manufactures, uses, displays, advertises, distributes, offers for sale, sells, or possesses. |

Columbia gal, I bet you know who Rosie is or you wouldn't have went to the trouble of looking up the law. Wouldn't you hate for Rosie to go to prison for 5 years? I wonder if she has a LV bag to match prison stripes?

No, I dont know Rosie, but I do know the law and hate for it to be misquoted and misrepresented by someone who claims to "know" something. Before you make statements, you should know the facts or else you are absolutely uncredible in your comments. It takes all of 30 seconds to look it up online and read it verbatim.
Yeah...I absolutely agree with you. People have to try to make trouble for anyone they can. I would be more concerned about who was selling drugs to the kids than who is selling or buying a fake purse. That doesn't exactly constitue a major deal to me but to each his own. I would rather someone sell my child a fake designer purse than a hit of crack! |
