It only takes one juror to hang a jury. There are no consequences to a juror if they vote "no" to anymore convictions, even if the facts prove that a crime was committed. The article claims that law enforcement has an obligation to bust growers who appear to be profiting. However, growing and providing to medical marijuana patients is a service and there are no victims. This should not be a proper use for our precious law enforcement dollars. As a juror, you will receive your instructions from the judge, who does indeed have the authority and legality in such matters. pot is ubiquitous .. it's everywhere... teachers use it .. cops have it .. elem kids smoke it ...it grow wild in most of the USA... there is medical heroin, medical cocaine, med morphine, etc ... why not medical pot? Judges can and do overrule jury decisions, especially on appeal. But a single juror can prevent a conviction for a marijuana offense. And some say, in Santa Cruz County, you can't find 12 jurors who all agree that the drug war against pot and pot smokers can be justified.

BECKY: A juror who has decided to use jury nullification rights to hang a jury for a marijuana "crime" must avoid being thrown off of the jury. They must answer all questions honestly during the voir dire or risk a perjury charge as well. They must not say during deliberations that they know the person is guilty, but are going to vote "not guilty" anyway. They just must insist that in their best judgment, justice in that particular case called for a "not guilty" vote. BLONDE WRITES: "Potential jurors - follow the law and ignore BJ. And we have made some progress. The juror is our best defense against this irrational law enforcement.

Marijuana should be legal not only for medical patients but for responsible adults who prefer to use it as a healthier substitute for alcohol. Our current marijuana laws are impossible to enforce. Despite decades of marijuana eradication and despite arresting 800,000 people a year, pot is still easier to buy for most high school kids than beer. Keeping marijuana illegal does not benefit our children. It benefits special interest groups: drug cartels, the prison industry, police departments, and government bureaucracies. It is immoral to prevent responsible adults from choosing to use a less harmful substance in place of alcohol. If pot were legalized, alcohol use would decrease along with its associated social costs. If you want marijuana to be legalized, taxed, and regulated for adults, YOU can make it happen.
