public intoxication - false arrest?

my sons were arrested saturday morning and my car impounded by officer Ashmore T123, they were charged with Public Intoxication. It was early in the morning, they had not been drinking and they requested an opportunity to blow in a breathalyzer to prove they were not intoxicated but she refused them, then she never read them their rights. Has anyone else in Cleveland or around the area been subject to her false accusations / charges / or arrests and if so will you please contact us to further our legal actions against the charges and to pursue a dismissal of the charges. This is a highly costly situation to young people, especially when they are innocent and not allowed the chance to prove so. We have heard from wrecker drivers and other officers that she is notorious for this type of behavior. Please contact or post ASAP, as our trial date is Wed, Aug 26, a mere 5 days from the arrest, although they make you wait 10 days for the report. Thank you.

Good luck! You should be glad they did not plant any drugs on them. This city is well known for their bad behavior. My parents (married for 60 years) were murdered in this so called town of Cleveland, Texas. It is going on five years, and nothing and no-one will step up and help us. I have been at the FBI office asking for help, but they cannot help if the police department does not want their help. One of my sister even went up to Cleveland with some information about what people were saying and they (the detective) told her you also have family members that are not that good. Have you heard there are a lot of arrests, all they care is the amount of money it is going to bring in to them. Also there are around 6 or 7 unsolved murders in this so called town. But then all the citizens say they know where the crack houses are and they will not do anything about it. Sorry this happened to your sons. They have ruined them for life.

To Reply to "They have ruined them for life" - I sure as hell won't give them that power. I have retained an attorney for both, which is ridiculous, as this is a a measly misdemeanor. But there is no way they are putting this on their record as they are INNOCENT. Many attorneys that I screened have similar defendants who were arrested by the same Officer Ashmore, and the attorneys all had the same response when they learned the arresting officers name, "She is a defense attorney's dream come true" Because she is out of control, these boys were innocent as I am sure many others who have been victim to her accusations. Even colleagues of hers have admitted that her proffesssionalism is questionable. Unfortunately, you are correct about the lack of attention that small town police departments have for major crimes as well. I am very sorry for the trajic events that have occurred to people in Cleveland, I have seen it in many similar small towns, the PD's just don't have the experienced officers or knowledgable detectives necessary with investigative skills or the desire to solve the crimes because of the impending danger it can also place them in. Cleveland, Dayton, Liberty, Splendora, New Caney, and Porter have many white supreme group members/leaders and activist. Unfortunately, they have many crack houses and move/transport for each other and provide support to their members who are locked up, and their members who are actively being supported by the community or those who hold positions of power in those cities. It happens everywhere, I know. Sorry, got on a soap box.
Believe me, we will fight to prove my sons innocence and hopefully effect some changes with the personnel dept at the PD, as far as having some more apt officers on the streets. Hopefully their investigative officers will learn or receive more help, training or assistance in solving their more serious crimes in Cleveland and avoid more frivolous cases such as ours.

I totally agree with the comment made by guest. As you stated this is a small town with small towns surrounding it. You will be harrassed on a regular basis. We all know what goes on around us, but we just choose to mind our own business. Hope your prepared to stir up the pea pot, cause I'm sure your on the right path. Hope you are ready to be ran out of town. Fight for your boys, but dont start rumors! Thats gonna be more troble for you. May GOD be with you!!!!!!!!!!

That is the problem, everybody chooses to mind their own business, I hope they don't kill one of your family members, and then I want to see you look the other way, because nobody knows that people have to start talking and protect one another, it does not matter if you are white, black, hispanic or any other race. And you are right we have called in a lot of tips and they never answer our phone calls. Tomorrow they might murder one or both of your parents, one of your kids, or a family member you really love.
