Callahan granted third trial in murder of classmate

A twice-convicted murderer will head to trial for the third time. A new trial was granted for Andrew Callahan, 28, who was previously convicted for the 1997 murder of his classmate Micah Pollock. Both were teens at the time.
According to Clearfield County District Attorney William A. Shaw Jr., the Superior Court ruled that the trial judge at Callahan's second trial in 2007 failed to give the jury proper instructions regarding an involuntary manslaughter charge.
At his first trial, Callahan was found guilty of murder, but not guilty of involuntary manslaughter. His second trial was also a result of improper instructions given to the jury.
Callahan has been convicted of murder and sentenced to life in prison at both trials. Shaw anticipates a jury will be selected for the third trial on Jan. 14. Callahan is currently housed in the State Correctional Institution at Cresson.

Isn't it the judges duty to instruct the jury?

I hope Andrew sits in prison for the rest of his life for taking away someones son, friend, boyfriend, acquaintance, even a stranger. How dare him even try to take it to trial again, this obviously shows no sign of a concscience or remorse!! What kind of person is capable of committing a murder of that degree? Please keep him locked up from all society!! FOREVER
