Officer in Chino cleared in man's fatal shooting

Since Jose Garcia had already shot one girl in the chest, and his girlfriend in the arm, it sounds justifialble to me. He had ample time to surrender, but instead paraded his girlfriend down the aisle as a hostage. Utlimate cause of his death was his bad judgement, not the officers judgement.

no brainer, he should be cleared!

Chances are, he should have been cleared. But, there is a good chance an investigation into possible criminal behavior on the part of the officer was never opened in the first place. It certainly was not when Landrum was shot in '99.
