Smothermon Answers Questions

Full story: The Shawnee News-Star

There was discussion and questions on why he worked a plea deal with the stepfather and then took the mother’s case to trial. At the end of the day, he said there’s evidence it was one of them. “To this day, I can’t tell you who killed Kelsey,” Smothermon said, adding some evidence pointed to the stepfather, while other evidence pointed to the mother. “There’s are a great deal of questions on whether I sent an innocent woman to prison,” he said, commenting on several Web sites that allege the mother, Raye Dawn Smith, was “railroaded.” “But there’s no doubt in my mind she assisted or allowed it (child abuse),” he said, “or quite possibly she committed some of it.”

Not really interesting if you ask me. Politics as usual, he stated during trial he thought Porter was the murderer, but when the pressure builds, politicians tend to change their minds

Yep. Bill Peterson, the prosecutor in Ada, OK, has never admitted he was flat-out wrong in the case of Dennis Fritz and Ron Williamson either. Even when DNA testing positively excluded both men as the actual perpetrators. I believe he's suing Mr. Fritz, Mr. Grisham, and Mr. Mayer, the authors of books making him look bad. Sounds to me like this prosecutor is taking lessons from Mr. Peterson.

Very true, prosecutors rarely admit fault, they are after all elected officials and must answer to the majority favor. I believe the prosecutors in another high profile case, the Cynthia Sommers case refuse to admit any fault there either.

the freekelseysmom site has posted all over it that the da in this case stated mike porter committed murder, they use the da's word.the da said mike porter did all of it and freekelseysmom uses that as a crutch, what now? i hope raye dawn smith does get a new trial and he uses the evidence that pointed at her. if she gets a new trial he will be the prosecuter, you probably shouldn't bite the hand that feeds you

what does what mean? she shouldn't bite the hand that feeds her? it means they should probably stop trashing the very person that will be the one that prosecutes raye dawn if she gets a new trial, kind of dumb to publicly trash the person who holds that position

What ever or how ever he choices to dance around the issue, does not absolve him from the fact that the cause of Kelsey's death was murder and he failed her not once but twice and still no one was convicted of her murder. He may have told Michael Porter he believed that he murdered and sexually assulted Kelsey and believed him to be a liar but he knew he could not manz up to the job he should have done. Good job featherman.

If LE had done THEIR jobs from the beginning, maybe he would have had the clear evidence needed to prosecute the murderer.

Not sure what LE is abbreviation or acronym for something. If the OSBI and Medical Examiner didn’t paint a clear enough pictures perhaps he should not be prosecuting. I doubt if he could track a bleeding polar bear through Siberia. IMO he made a deal with the devil to get public and media approval and he still is. David Prater would have knocked a home run on this one and wouldn’t have to be explaining three years after the fact of failure to perform. Sorry dear but Prater would have housed them both for life, with one sitting on death row or both. But then again we are not talking about small town justice. Prater is not running a popularity contest; he prosecutes and delivers real justice.

Donna dear, LE is Law Enforcement. And if David Prater could have gotten them both housed for life, then too bad he wasn't the prosecutor.
The crime scene was not treated as such from the beginning. Both RD and MP were allowed BACK IN that home the very night Kelsey was murdered, among other things. Such a shame.
Nothing would make me happier than for BOTH of them to be doing life.

Look at the reasonable doubt issue. No way to get a murder conviction for either MP or RD. Too many people with opinions. Both had the opportunity to hurt Kelsey. They are both in jail regardless of the charge.

Nouse, not every one who blogs on this site is quite as savvy in the terms you use. Just because in your world VPO, or EPO, LE is a daily way of life does not mean every one else should know. I myself wondered what LE meant but knew your white trash attack mode and yes you love to think you know who someone is.

No, I'm not Starla, but thank you for the compliment. She knows this case well and the only reason you Raye supporters do not like her and Shonya is because you can't scare them off, they stand up to you and stand up for what they believe in and for the FACTS. A good thing in my book. I want to be just like them when I grow up.

Call me names all you want, lol I care so much what you think anyway.
In my world its a "daily way of life" because I am aware of what goes on around me in my community and do my part to help victims and bring awareness to child abuse and domestic violence in my community. If that makes me a bad person, then that's ok too.
