This mother is looking in at whats best for her daughter's interest and no one will see that....she's got everyone blinded at the moment.....what can be done?? this is just the surface of the story.

This is a horrible circumstance! Sexual abuse is hard to prove and I have very little advice but I will try!
The father has to fight for full custody and supervised visits! He can file pro se but he has to be careful about doing so! Wild accusation with no proof will ruin is creditability! Gardem atlitums (excuse me while I miss spell) are definitely a bad option! Them along with CPS have no objectivity and abuse their power. You never know why they are being protective of the mother or their motives! The object of their game is to gain the favor of the judge (just like a lawyer) if they look wrong in court they are out of a job.
The evidence this man needs to proven by a medical examination! If she has been molested and there has been medical evidence, along with an 8year olds testimony than this should be valued in court!
Yes judge Pflum is well known for favoring the mothers but based on his experience with the fathers in Connersville you might see why! Getting a local attorney could be beneficial might I recommend John Alexander. Beware though John Alexander is very cut and dry and be viewed as abrasive if he has caught wind of this case and realizes the judges position on it he more than likely will not take the case! But if you can present a testimony from the child (preferable in writing, because you don’t want to put a young girl in court testifying against her mother who she loves). John Alexander’s cost is roughly 1500.oo and keep in mind the father may have to do most of the leg work! This can be frustrating! But the money is worth the time in court with John Alexander. He wins the majority of cases and stays in good standing with the judges! So in the end it can worth it!

well i have first hand experience with being molested. I told it went to court and was originally a hung jury then a conviction with the second jury. I was 3 at the time and had received a std from my abuser. For some reason a lot of people (juries)(judges) don't want to believe the children even when its all layed out in front of them.

This was going on with my neice and I reported the situation to family services. They removed my neice from the house. The process happened within a couple of weeks. There was an investigation and they gave my brother full custody. Good luck!

It is apparent most of you people are bitter, uneducated, and naive...right someone who works for kids in the Courts is in with all the Judges, attorneys, police, DCS....there has to be evidince people!! Put yourselves in the Judges shoes, you cannot change custody because of he said she said. I worked with Barb Mayle and she knoows the system in and out and is direct to the point and is highly respected throughout the state of Indiana. Hurts to hear the truth sometimes, I imagine she does not care what people think of her or she would not do this type of thankless work. the kids must keep her going. No one hires Barb the Judges appoint her on all of their difficult cases.

You are clueless about how things work. Judges cannot deny themselves being removed from cases.

Well I had Barb and she dug up so much background on my new husband with her investigation, I lost. She did her job which was to investigate...she used to be a State Cop my dad told me, so I doubt she sides with drug dealers...also I was a Mom and the Dad won custody so I think she probably is fair or they would not hire her. She works for Union County too, my niece has her in a case and loves her.

We too have a GAL who is not doing her job. Yes, she is supposed to be the voice for the children but is refusing to come and look at a nine yr. old boy who was battered by his mother. The father took the child to the RPD and filed the report with pictures to prove it. RPD did nothing. The next day when the boy was picked up by his mother, she told him she knew how his day went since she knew he and his father had filed a battery report against her. When he asked his mother how she knew that she stated that Barb called me and told me. That same evening, after another confrontation between this mother and the son, the mother called someone who told her to call the police on the boy. He thinks it was Barb. Mother called the police and the police threatened this little boy who has never been in trouble in school that she would hall his ass off to a facility for bad boys. He said he tried to tell her about his brusies his mother had put on him a few days earlier and she told him to shut his mouth. He then said the officer told the mother to call her if he kept acting up and she would come over and help hold him down so the mother could beat his ass. During the interiogation (sp?) on Wed. of the nine yr. old boy, the detective also refused to hear the story about the battery that took place on the Friday night before. He only wanted to know why this 97 lb. boy was being soooooo mean to his mother who weighs about 180 lbs. and is taking karate lessons. The GAL finally called the father on Tues. but by then, the mother and she had already come up with a plan to "counter-act the battery report. She never did come and talk or look at the boy and his bruises which he still had a week later. This is Barb Mayle. She has been on the mother's side all along. Since she serves on the board at CPS this child has about as much chance of being heard in court as a snowball has a chance in Hell.

Barb Maley is a joke. I know this first hand. She kept instigating and exacerbated the animosity between my daughter and the father of her son. Once she was out of the picture, the parents got along fine and the child now has the best of both parents and their families. Upon reporting her to the state, I was told there were numerous complaints about her, and the rep I spoke with stated she didn't know how Barb kept her position in Wayne County....but then again...as far as justice is concerned....Wayne County is a State joke!!!!!!

when i read this , i thaught oh my god some one has wrote about my step daughter. this case sounds sooo much like ours.my six yr old step daughter came to us in july 09 and told us her two step brothers were touching her on her private parts. we called c.p.s. she told 2 workers what was going on. she aslo said that her mom and step dad knew but told her not to tell any one. we went to the cops where there was a criminal investigation opened for sexual battery on her in her mothers home. we went to the d'a's office and let them know per penal code 278.7 it was my husbands right to with hold his daughter for up to 30 days to try and get the court order changed with no charges to be filed for kidnapping. so he did that. it pissed the judge off for going against his order and he places my daughter in the home full time and put my husband on supervised visits four hours a week, there was a c.p.s investigation done and an investigation done for the court by his own mediator. all in which was great for us and bad for them. even to the piont where c.p.s said if they didnt cahnge thier living conditions which was under standards they would have c.p.s involved with all 6 six kids, they have 3 on social security, 3 on welfare and 3 recieving child support(300.00 a month from us). after the judge put my step daughter in mom's home it took us 3 months to get half custody back. mom went and put her on meds (fokaline)for adhd and she is not adhd. she acts great with us. we even refused to have her on her meds while she is with us for every other week. her teacher says she does great in class after she has been with us for a few days that is is the mom's home that has her acting like thes. and the kicker is the mom took her to c.p.s 2 years ago and said this child would say things like " lets have sex now" and trying to put things up her pee-pee( baby bottles ) she said that the step dad wanted to shower with my step daughter and my step daughter was asked about it said she didnt like it because his pee-pee was in her face. last week the judge ordered us not to have her in victim witness counseling and that we are not allowed to have her in any type of counseling untill after the trial is over. they recieve over $3,000 a month for all these kids. they are now trying to get my step daughter on it for adhd. they dont work and as for the step dad he is 31 and has never had a job. they make over $3,000 a month off these kids and dont have nothing. they live in a cockroach infested, mrsa infested filthy trailor park in oroville ca.and you want to know what else pisses me off? they have had 17 c.p.s referrals in 6 years BUT THERES NOTHING WRONG>>>>> >>>>>>my step daughter came to us last week and told us that her step brothers were still touching her and she told her mom and step dad and they sat them down and told them if anyone asks to say no. yesterday we picked up and she wont talk to us at all. she said she doesnt want ot go live with strangers and have them hurt her. so this is obviously what they are telling the kids will happen if they tell any one. the judge knows all of this and refuses to remove from the home. is it the judge's fault that she is still being molested and abused and can we sue the judge personally for this bad judgement... oh wait i forgot to tell you. thier attorney is another judge's wife from the same court house.... favortism + abuse of power = child molested.......

Be aware, most GAL's in Wayne County are only in it for the money as are the case workers. Until these folks become foster parents or Big Brothers/Big Sisters and deal with these children on a daily basis, they have no idea what the kids go throuth or need. You can read all the books you want and get all the paperwork that goes along with it but until you live it you don't know. And beleive me these "voices" don't know and don't care. We have proof.
