I have a home which is over 30 years old. Some of the plumbing copper pipes have been springing pinhole leaks this summer. Nothing too bad but worrisome. They seem to appear more on horizontal runs than on verticle, although I've had leaks everywhere.

I'm worried about the cold weather coming with these bad copper pipes.

Can anyone recommend some relatively inexpensive fixes or if necessary some reasonable and professional company in the McKinney area who could help?

We had the same thing happen just recently. Fortunately homeowner's insurance policy helped covered some of the loss. There may be several reputatable companies close by, but the most highly recommended was Herndon McFarland Plumbing (Commercial and Residential) out of Addison. Lee McFarland is the owner. He spent a lot of time explaining, giving advice. They were honest and efficient.

We had a similar problem and had to have most of the copper plumbing replaced. We learned that Mexican Coppers are often corrupt.

It turns out that Mexican Coppers are of inferior quality, often incompetently made, short-cuts are used and are far from the class of noble metals.

They often contain impurities and are their makers are sometimes disreputable.

When you replace your pipes do not trust Mexican Coppers to protect your home from leaks. Buy domestic product.

There are a number of good plumbers in our area. If you are a DYI’er, get advice from Home Depot or Lowe’s.

Lesson learned. Do Not Trust Mexican Coppers!

I have to agree with you as we’ve shared the same experience. Not with general people of Mexican decent who to us seem to be hard working people just trying to raise their families and get ahead.

But there definitely is something wrong with the coppers we pay for in this area. While the problem seems to be a McKinney one, it surely must be impacting other areas.

So much damage was done to our home by the corrupt coppers from McKinney and the incompetent way it was worked. Sloppy, unprofessional and incompetent. We had to have entire walls replaced. Luckily my husband is handy and did all the work himself, although because of his day job it took a few weeks to get done properly.

When we complained to the management and the head plumber who were responsible for the corrupted McKinney Coppers they lied directly to our faces saying the metal was pure.

My husband showed them the incontrovertible evidence that it was in fact of poor quality, corrupt with impurities, and their work incompetently done. And do you know what their major concern was?

No, it was not fixing an obvious problem. It was to lie to us and hide the problem and try to shield themselves from liability for their faulty performance. They were afraid of the truth coming out.

We are filing suit against these sorry excuses for professionals.

The message above is absolutely correct.

Good Advice. Worth continued beating. The devil lies in the details and the horse is feigning death.

Mexican Coppers and their inferior American cohorts, even when proven to have been corroded and corrupted, still should have to obey the Laws of all types, such as the judicious application of the Laws of physics just to name one type of Law.

Their manufacturers, managers and mouthpieces will claim that they are immune from such laws - even when proven otherwise. They do so to protect themselves from their liability for procuring and covering up for their use of patently bad material. How do they sleep at night?

Did you know that in fact such codes were put in place at our peril within the smoke filled back rooms of the self serving District Attorneyal's Society Of Metallurgical Sciences?

Such codification is completely counter-intuitive and virtually no American has taken the time to find out that such is in fact the case. Laws have been passed to protect the corrupt behind our far too lazy, unwatchful and trusting backs.

No other type of material in this country or on earth for that matter are immune from any such laws. But they are.

When a truthful leak seeking plumber cuts into a house wall, and exposes the corrupted Mexican Coppers or it likewise corrupted American counterparts does he say "hey that's not possible, Mexican Coppers and their cohorts are immune from the laws and can not be corrupted by impurities”? Does he say,“let’s give the offending material a pass” and pretend they are not impure, deserving of dismantling and containment in a hazardous waste dump?

Hardly? Would You?

Even when on the exterior the Coppers seems shining and trustworthy, a diligent plumber will dig deeper and stress test the offender to find it is in fact rotten, behind it’s thin veneer of shinning metal.

The good plumber holds no truck with such lies.

He exposes the offending corrupted Coppers and with surgical and righteous skill cuts them out and incarcerates them in a compactor forever.

And then replaces the corrupt with the pure, while holding the latter to the dilligent and watchful high standards of metallurgy we expect and deserve in this country.

Do Not Trust Corrupt Coppers.

And make sure you’re are skeptical of trusting ones that are shiny on the outside; but foul, corroded and corrupt on the inside.

There’s far to many of such "pipes" lurking about unchecked in Collin County.

TX — Hillsborough County deputy arrested for forcing a woman to perform a sex act on him in his patrol car has agreed to plead guilty to sexual battery and false imprisonment and serve five years in prison, his attorney said.

Raymond Choy faced up to 60 years in prison if convicted at trial of sexual battery and kidnapping.

The deal with prosecutors calling for significantly less time likely prompted Choy, 37, to accept the state's offer, said defense attorney Norman S. Cannella Sr.

"It was a significant departure from the potential conviction and a significant sentence," Cannella said.

Choy is scheduled to be sentenced by Circuit Judge Wayne Timmerman on Dec. 10.

A hit-and-run suspect accused Choy of agreeing to release her from custody if she performed oral sex on him. Prosecutors said Choy arrested the woman on April 1, 2007, drove her to the dead end of Jefferson Road in Thonotosassa, then slipped into the back seat and removed her handcuffs.

The deputy drove the woman home after she complied and let her go, authorities said. She later called the Sheriff's Office to report the incident, and authorities arrested Choy when DNA test results linked him to the victim.

In July, Timmerman cleared the way for a second woman to testify that Choy also forced her to perform oral sex on him in his patrol car.

The second woman said in court that while she sat handcuffed in the back of his cruiser, Choy talked to her about a lack of oral sex from his wife.

Choy never specifically asked her to perform the sex act, she said. But she did it, she told the judge, because she thought it could mean her freedom.

Choy was never charged in that incident, which prosecutors said took place along the same dark road as the crime to which he is expected to plead guilty.

All metals corrode (even copper)due to the elements and particulates in our water, etc. Plastic lasts a lot longer. It also resist movement because it is a lot more flexible. People used to look down on plastic pipe but, they are learning that properly installed and insulated plastic pipe will last several time longer then copper.

A police office was sentenced Thursday to spend two years in federal prison after an earlier GUILTY plea of violating the civil rights of a mixed race couple.

Matthew Leavitt, 31, of South Charleston was also sentenced to two years of supervised release following his prison term.

U.S. District Judge Joseph Goodwin called the case "disturbing" and said Leavitt's behavior "shocked my conscience."

Leavitt arrested Lauren Reynolds on Sept. 26, 2008 and charged her with DUI even though a Breathalyzer test showed she didn't have any alcohol in her system.

He also admitted to striking Twan Reynolds several times with a slapjack, an unauthorized weapon, using unreasonable force.

Judge Goodwin said at Thursday's sentencing that more than 20 complaints had been filed against Leavitt alleging illegal searches and arrests.

Black men made the complaints or white women who were dating black men.

Leavitt had to surrender his law enforcement certification as part of a plea agreement with federal prosecutors.

Goodwin also said during the hearing that Leavitt “terrorized” the victims’ family,“disgraced his uniform,” and “harmed the community” by diminishing the community’s trust in the police.

Law Suit Could Have Huge Implications On Collin County Convictions

Roach’s Lab – Infested.

WFAA, Channel 8 News is reporting that a law suit has been filed by a former scientist at the Southwestern Institute of Forensic Science (SWIFS).

SWIFS is the Dallas County crime lab. The law suit alleges that the Institute engaged in "sloppy science" and "slip-shod analysis".

Dr. Chris Nulf, a forensic biologist alleges that expired chemicals were often used; case files sat unsecured; and a box fan blew over areas in a lab where evidence was examined. He maintains that he was fired by SWIFS as retaliation for pointing out problems at the institute.

The WFAA article reports that:

"Dallas County District Attorney Craig Watkins, who has earned a national reputation for freeing wrongfully convicted inmates, told News 8 that his prosecutors might have to review more closed cases if Nulf's allegations are true."

"'Obviously,' Watkins said.'Our ultimate goal is to seek the truth.

If there's an indication that something was done improperly, then we will take the appropriate measures to make sure we rectify it.'"

A quick Google search turns up that COLLIN COUNTY PROSECUTORS HAVE USED SWIFS IN AT LEAST TWO HIGH PROFILE MURDER CASES THAT RESULTED IN CONVICTIONS BEING OVERTURNED.

IN THE FIRST CASE MICHAEL BLAIR WAS SENTENCED TO DEATH IN 1994 FOR THE KILLING OF YOUNG ASHLEY, BUT THE CONVICTION WAS OVERTURNED 14 YEARS LATER AFTER A SEPARATE DNA ANALYSIS PROVED HIS INNOCENCE.

ADA BETTY CUADROS-FERNANDEZ WAS CONVICTED IN 2006 OF THE MURDER OF 14-MONTH-OLD KYLE LAZARCHIK.

EARLIER THIS MONTH, A TEXAS COURT OF APPEALS OVERTURNED HER CONVICTION, IN PART BECAUSE JUDGE ROBERT SANDOVAL WOULD NOT LET HER ATTORNEYS CROSS EXAMINE A TECHNICIAN FROM SWIFS WHO PREPARED A DNA REPORT.

THE TECHNICIAN WAS ON MATERNITY LEAVE AND WAS NOT REQUIRED BY THE JUDGE TO TESTIFY.

"Crime labs in Fort Worth, Houston, and even the Texas Department of Public Safety have all faced questions about their facilities in recent years."

"Critics say one of the biggest problems is that like Police Department’s the industry polices itself.

No government body regulates, inspects, or oversees them."

"In a detailed report earlier this year, The National Academy of Sciences suggested oversight is overdue."

. If the charges against the crime lab are proven in court, it will call into question thousands of criminal convictions in the North Texas area.

Juries are told that forensic evidence, especially DNA is fool proof, but in reality the test results are only as good as the lab procedures followed.

The Collin County Observer has requested information from the Collin County DA's office on the number of convictions or cases tried using evidence from SWIFS.

After posting this, I have received several notes from local attorneys who tell me that SWIFS IS THE PRIMARY CRIME LAB USED BY COLLIN COUNTY LAW ENFORCEMENT AND PROSECUTORS.

DA JOHN ROACH sent me an email promising to provide me WITH "AN OVERVIEW OF THE USE OF SWIFS BY THIS OFFICE."

Also see Grits for Breakfast coverage. Grits was sent some photographs of supposed violations at the lab, including expired chemical reagents.

On Wednesday, WFAA published an article detailing Dr. Nulf's complaints.

They include:
"But in a lawsuit to be filed Wednesday, Nulf says he was terminated for pointing out problems inside the lab, including:

- an outdated protocol manual used by analysts to conduct their daily work

- equipment that isn't calibrated

- analysts using expired chemicals

- criminal case files stored in an unsecured hallway

Yeah, but that plastic stuff melts all over the place when I try and sweat fit it.

Dallas police gave 38 improper no-English tickets

10/23/2009

Police officials say they have uncovered 38 cases where Dallas officers improperly cited drivers for not being able to speak English.

Chief David Kunkle said Friday the discovery came after a woman was pulled over earlier this month for making an illegal U-turn and was given a ticket for being a "non-English speaking driver."

Kunkle said his department's computer system for citations has a pull-down menu that includes a law requiring drivers of commercial vehicles to speak English.

The chief said it was a federal law that was misapplied to local drivers of private vehicles.

Kunkle says at least six officers wrote the citations. He said the officers and their commanders are under investigation.

Dallas Officer Guilty Of Assault
Friday, October 23, 2009

DALLAS — A state district judge Thursday found a former Dallas police officer guilty of aggravated assault for holding country music singer Steve Holy at gunpoint in December 2007. But Judge John Creuzot ruled that Randy Anderson is not guilty of kidnapping.

Anderson, 27, had already pleaded no contest to one count each of aggravated assault and kidnapping and had asked the judge to decide his fate during a three-day bench trial. Judge Creuzot will likely sentence Anderson – who is free on bond – next month after a pre-sentence investigation.

Another officer, Paul Loughridge, 50, is charged with one count of aggravated assault in connection with the altercation. A trial date for him has not been set.

Before the verdict was announced Thursday, Anderson testified that he only pulled his gun on Holy after the musician tried to shut a door on him and acted as if he was going to charge at him.

"I was acting as a police officer through my training and my instincts," Anderson testified.
He and Loughridge were both fired within weeks of the off-duty, alcohol-fueled confrontation that occurred at Holy's Greenville Avenue-area home.

( So, the description of acting as a police officer is :“an off-duty, alcohol-fueled confrontation that occurred at Holy's Greenville Avenue-area home”?)

According to previous trial testimony, the confrontation occurred hours after another Dallas officer introduced Loughridge and Anderson to Holy at a bar near Holy's house.

After the bar closed, the singer invited the two officers and a friend of his, Walter McRae, to his home, where they drank and played foosball.

Anderson testified that McRae, had become increasingly drunk and agitated and had finally passed out on a couch in the garage. He said Holy woke up McRae, who began acting belligerent. Holy told his friend that he would have go to go home because his wife wouldn't want him to spend the night, Anderson said.

Loughridge then agreed that he and Anderson would take McRae home.

Anderson said they asked McRae where he lived but he was too drunk to tell them. He said he then asked Holy where McRae lived, but Holy said he didn't know and didn't know McRae's last name.

"None of this added up. It just seemed fishy," Anderson testified.

Anderson said he asked Holy to show him some identification, but Holy said it was upstairs and he didn't want to go get it because he didn't want to wake his wife. He said Holy showed him a credit card with his name on it, but he told Holy that he still wanted to see some identification.

As he stood in a doorway, Anderson said, Holy tried to shut the door on him.

"He balled his fists up and acted like he was going to come at me," Anderson testified. "I drew my pistol from behind my back and pointed it at his midsection and told him to step back and sit on the ground."

In his testimony earlier this week, Holy denied making aggressive moves toward Anderson.

Both Anderson and Loughridge, who testified Wednesday, denied Holy's account that Loughridge brought the gun inside the house to Anderson.

Anderson testified that he started up the stairs of Holy's home when Holy's wife appeared on the second-floor balcony. He said he showed her his wallet badge.

"I was like,'Who is this guy sitting on the floor?' She said,'That's my husband, Steve Holy,' " Anderson said.

Anderson denied threatening to kill or harm Holy and said that after Holy's wife identified her husband, he and Holy shook hands and agreed that the confrontation had been a misunderstanding.

DWI case disappears in Collin County courts

PLANO — Two North Texas men who tried to get a drunk driver off the streets and into a courtroom are confused and upset.

The seemingly IRON-CLAD DWI CASE AGAINST THE DRIVER SOMEHOW VANISHED IN THE COLLIN COUNTY COURT SYSTEM until News 8 became involved.

Adam Bennett and Steven Tibbles were scheduled to tell their story to a jury this past summer, but never got the chance. So they are telling it to News 8.

Last November in Plano, Bennett and Tibbles say they witnessed an apparent drunk driver.

"He swerved over and almost hit us," Bennett said. "Another car passed him and he almost hit him as well. He almost hit several cars." Tibbles said the driver “obviously was not suitable for driving."

The incident report spells out what happened next.

The driver failed the field sobriety test.

IN THIS CASE, THE DRIVER "BLEW" A 0.14, NEARLY TWICE THE LEGAL LIMIT.

Bennett and Tibbles were subpoenaed by the COLLIN COUNTY DISTRICT ATTORNEY'S OFFICE and were eager to testify.

The Collin County prosecutor assigned to the case amassed seven witnesses, gathered all the evidence, and set the trial for June 22.

But ten days before trial, something happened.

THE COURT'S CHIEF PROSECUTOR, KERRIE WALKER, TOOK THE CASE AWAY FROM THE ORIGINAL PROSECUTOR.

WALKER DISMISSED ALL THE WITNESSES AND FILED PAPERWORK WAIVING THE JURY TRIAL.

SHE RESET THE CASE FOR JULY 23, A DAY THE REGULAR JUDGE WOULD BE GONE. IN HIS PLACE WAS A VISITING JUDGE WHO HAD NO PREVIOUS KNOWLEDGE OF THE CASE.

On the day of the hearing, Walker apparently presented no evidence or witnesses.

The driver, who allegedly posed such a threat to the public, was quickly found "not guilty."

No probation.

No community service.

No fines.

And — according to the witnesses to the crime — THERE WAS NO JUSTICE.

"Where's our justice system?" asked Tibbles.

"Why do we have laws if that kind of thing is just going to happen? If people are just going to be able to walk from an open-and-shut case?"

Bennett and Tibbles say they have several questions for Court Chief Kerrie Walker, who abruptly took over the case.

Walker declined to discuss the case with News 8 and referred us to her supervisor, CURTIS HOWARD, WHO ALSO HAS DECLINED TO COMMENT.

HOWARD WAS ALLEGEDLY NOTIFIED OF THE DISAPPEARING DWI CASE THIS SUMMER.

HOWARD FAILED TO PASS ALONG THE CONCERNS TO DISTRICT ATTORNEY JOHN ROACH, WHO SAYS HE HAS A ZERO TOLERANCE ATTITUDE TOWARD DRUNK DRIVERS.

( Really Curtis! You guys are actually pulling out Richard Nixon's "Plausible Deniability” defense ??)

"If we can prove that you committed a DWI, then we are going to prosecute that case," Roach said. "It's just that simple."

Now that the case of the disappearing DWI has come to his attention, Roach said he has concerns of his own. HE SAID BOTH WALKER AND HOWARD HAVE BEEN REASSIGNED PENDING A FULL INVESTIGATION.

"Nobody should be making any mistake about what my attitude is and what my policies are here, and people who deviate from those policies without some excuse or justification are going to be investigated," Roach said.

( "Don't worry Johnnie, we know EXACTLY what your real practices actually are. " )

WFAA - DWI Case Disappears In Collin County Courts

“This is a very disturbing story.

It involves a DWI case that APPEARS TO HAVE BEEN "FIXED" BY A SENIOR PROSECUTOR IN THE COLLIN COUNTY DISTRICT ATTORNEY'S OFFICE.

DA John Roach's response six months later?

1.'Reassign' the prosecutor accused of the 'fix' and her boss.

2. Fire the original prosecutor who had the case taken away from him by his superior and then complained about it, in what sure looks like 'firing the whistle blower'.

3. Complain about the laws that allow people found innocent to have their arrest records expunged.

4. Order an investigation.

(“If it looks like a dead fish, is decomposed like a dead fish and STINKS like a dead fish --- it’s probably a dead fish.”

Dare it be said that this appears to “smell of a cover-up”?)

The DWI arrest in question was last November.

The 'fix' was in June.

HOW MUCH TIME DOES MR. ROACH NEED TO ASK HIS OWN EMPLOYEES WHAT HAPPENED?

Collin County and its District Attorney have a well justified reputation for being tough on law breakers.

Unless he wants to be seen as just another good ol boy politician protecting his own, Roach needs to take swift, public and decisive action to bring anyone guilty of a breach of the public trust to justice.

( "Six months of keeping it hidden under the rug - then the media finds out. Under no circumstances can any action now be qualified as 'swift' "...)

Roach says he has zero tolerance for drunk drivers.

He needs to reassure the citizens that he has exactly that same amount of tolerance for those who abuses the public trust in the justice system.

DA Roach is retiring at the end of 2010.

( To those in ”the know”, very interesting timing.)

His actions and that of 2 of his prosecutors should provide grist for an interesting discussion between the candidates who want our votes to become the next district attorney.”

I’m not sure I quite understand Mr. Roach’s “position”.

Isn’t it correct that it is Mr. Roach’s own department that “made this case disappear”?

Isn’t it true that it is Mr. Roach’s own department that caused the case to be expunged?

If one is charged with a crime and proven innocent, the arrest records are not expunged. The falsely accused person has to file for a hearing or suit to have such records expunged, often taking years, and at their own, innocent, expense. Correct?

Yet, Mr. Roach, according to the article, audaciously feigns being “frustrated by the Texas expungement laws”, stating he has been fighting to have them changed.

What?

Aren’t those the same laws Mr. Roach’s own department utilized, as the article indicates, to make the case disappear and hide the identity of the driver at issue in the first place?

Mr. Roach,“the Emperor has no clothes”….. and guess who the Emperor is in this regard? Look in the mirror.

It seems that Mr. Roach’s pending exit as DA may have some pressing incentives behind it.

Perhaps the ship has been exposed and holed by sharp rock, is sinking and it’s time to slither off the boat rather than to publically go down with it?

2 Cops Sued For 3rd Time This Year On Sexual Harassment & Discrimination

OMAHA, Neb.(AP)- More people are suing a northeastern Nebraska county, its sheriff and other officials for sexual harassment and other mistreatment.

A lawsuit was filed Monday in U.S. District Court on behalf of 8 men and women who work or had worked at the Dakota County Jail.

The lawsuit states Dakota County Sheriff James Wagner and Chief Deputy Rodney Herron sexually harassed employees, including pressuring female employees into sexual relationships.

At least two other lawsuits making similar charges were filed earlier this year.

The Dakota County Attorney's Office referred questions to Lincoln attorney Vincent Valentino. He did not immediately respond to a phone message left Monday.
