this is the god damn attorney generals office doing their best to prove was a bunch of douches they really are. I don't even think Cuomo know about this. But this is what they do...they fucking lie and paper everyone's file costing no only the taxpayer money but the poor unforturnates who try to tell the truth. What a bunch of asses the attorney generals envorimental dept has become. A buch of idiots. Look at the fact...I hope they get an investigation into this dept....it's a call to justice..i suggest they call the Fbi...cause the rest of the state closes their eyes.

So, if I understand the issue, the oil company is off the hook for oil contamination, and the insurance office is liable.
We really do need change. Get rid of all of them. There isn't a politician out there worth a s*i*. |

I am OUTRAGED by this story - how the f ** k can an insurance office be liable and NOT an oil company for an oil spillage from years ago? This is a PAYOFF I bet.
The state harassing our elderly?... extorting money from WWII veterans? What a DISGRACE!! Someone is clearly taking advantage of the elderly here. If the state can't PROVE who was guilty of the oil spillage - then they should just EAT IT - it's a lot of money for these people, but certainly NOT for the State. I can't believe that Cuomo had anything to do with this. This will be a blemish in his distinguished career that's for sure - with ME anyway! I WAS one of his biggest fans! |

I agree that that the ag Coumo doesn't even know about this...he sometimes has advisors like spitzer making him see it their way instead of the truth. wake up Coumo...this advisors are most likely from the old whore master himself spitzer.

The state used to be littered with gas pumps. Not only gas stations and garages had them but all kinds of businesses. I know of a former bar and restaurant that had pumps. I guarantee those tanks, and a lot of other disused ones, are still in the ground.
An it not only gas tans. I know of a former iron foundry that dumped their waste in the backyard and it is there to this day, buried under a parking lot, abounding a stream. Wouldn't people be more likely to alert the state to these potential sources of pollution if they weren't in fear of being sued? Is it more important to correct these situations or to ruin people who had no idea what they were getting into. |

This is my quote off the other discussion.
Why isn't Cuomo's office going after any more of the Ogdensburg spills. There are 150 spills in Ogdensburg and any number of owners. There are 30 known spills just in the Marina district according to the EPA website. Oh I know.....It's because the City of Ogdensburg and some real wealthy politically connected people own most of the sites..... Stupid me.... Hell I used to play on the railroad bed by ACCO in the 60-70's there was all kinds of contamination, piles with oil oozing out, there was a pile of toy wheels with tar and oil . Tar everywhere. No telling what ACCO dumped back then. Paper mill chemicals etc. |

OK, everyone who is whining about why is the oil company not responsible needs to get a clue. The oil company DOES NOT OWN THE LAND. When they did own the land, they were responsible. The beauty of a free market is the value of the land was affected by the tanks contained below ground. I am shocked that these two bought a commercial property without a Phase I Environmental inspection being performed. That would have turned up the issue with the tanks and any contaminiation. The buyers would therefore be able to dictate terms of purchase to their benefit. If they failed to do proper due diligance prior to purchasing the property, it is their fault. As the land owners, the drums and their contaminants were part of what they purchased. Stupid on their part. A Phase I should be part of any purchase of commercial property and any decent bank will not loan money without reviewing the report.

Not the insurance company, the landowner. And the landowner should be responsible for their own land as they purchased it in that condition. |

Nobody knew what a Phase 1 or Phase 2 test was in the 1970's
It was after 1985 that Environmental laws pertaining to underground storage tanks,(UST) went into effect and many at EPA didn't have the science we have today. Not only that, but if these men were responsible for the clean-up why then did EPA and the City go after Exxon and have them clean that site up. They also paid a resident that owned a building there, 178,000 for his building and the EPA paid to have that one cleaned under the Brownfield Act!!! |

I think there is a Federal Law also that makes the previous owner, that ran a business on the property,
responsible if they could show that the business could generate that type of Pollution. I know of a marina that was bought out and the fuel tanks leaked. It went back to the previous owners and he had to pay for clean-up, almost what he sold the business for. |

I'll bet these old guys would like five minutes alone in a room with a hammer and the scumbag AG. I hope they realize that this is one of the rewards they've reaped for fighting their own kind on behalf of this degenerate government and system.

In the mean time these guys are paying legal fees and worrying constantly about whether this will fall on their families if and when they do pass on. This is obviously a misguided attempt my the state to steal money from its citizens. The state should drop this and move on. |
