well one thing i have to say its 2 years today that my mom is gone because of a drunk drive and none of them dammmm da would help us .with tears rolling down my face at the moment . its so dammmm sad they look for there self and there family .

Harson sure does sound like he's hiding something.

Mike Harson told the media "You come do the work.... If you don't want to sit down and do the work yourself, that's your problem." Attorney Ryan Brown says that the law is very clear in that the DA's office must maintain such a list for public scrutiny. The day the media published these facts, Harson said he found out he might be able to generate the list. Shortly afterward, the list was in the mail. "The National Highway Traffic Safety Administration found serious problems with the way Louisiana law allows prosecutors to handle drunken-driving cases. The report cites a lack of oversight and transparency, as well as potential for unfairness in the way prosecutors select cases for pretrial diversion." Harson said himself that he doesn't advertise his Justice Diversion Program. Instead, he grants the right to those friends and family who ask for the favor. |

Be aware that 58 percent of Lafayette Parish's 148 fatal highway accidents were related to alcohol, according to the Louisiana Highway Safety Commission. The national rate is about 39 percent.
For a fee [of $700], certain first-time drunken-driving offenders in Louisiana can enroll in a voluntary pretrial diversion program to avoid prosecution if they successfully complete program requirements. Some information was obtained from Harson's office.
For example, Harson said that from 2009 through 2011, his office sent 668 OWI cases... City-Parish Attorney Mike Hebert responded with a list from which much of the information had been redacted. Harson's office provided the number of cases sent to pretrial diversion: 192 in 2009, 221 in 2010 and 255 in 2011, for a total of 668. Requests for more detailed information was denied. "It is my understanding that my obligation under the public records act is to provide access to those records deemed public," Harson wrote in response to the open records request. "I am unaware of any provision that requires me to do any statistical analysis, compilation or other computations involving those records." Louisiana's district attorneys have full discretion in deciding which cases to prosecute, which to dismiss and, which are sent to pretrial diversion. But Louisiana law does not provide criteria that must be met to qualify for pretrial diversion. Asked for a copy of his guidelines, Harson said he did not have a written copy. When asked through a written request Harson provided written guidelines [a few days later]. |
