I'm hoping someone on here can give some advice. My ex-husband is trying to file for disability (inappropriately I might add since he's not disabled...just trying to get out of going overseas). He's losing his full time guard job in November and is getting "medically discharged" out of the guard. He is trying to go on disability but states that when he loses his job he won't be able to pay child support. It could take a LONG time for his disability to kick in. In the meantime not only is our son losing his child support but I am having to pay an additional $240 per month to cover our son on my health insurance since he will not be covered by his father anymore. Can anyone tell me how disability and child support works. He's already behind two support payments and it's only going to get worse. The child support office won't help me at all...I've already tried. What are my options and what can I expect if he actually gets disability?

What excuse did the child support office give you? I have the answers you seek. When you say disability do you mean from the guard? To start our conversation I will tell you he has NO CHOICE not to pay support and at least half the insurance bill.

I didn't get any excused from the CS office except "we can't find him to serve him papers." I not only gave him his address but his work address as well. Yes, he is trying to get disability from the guard and unemployment from his job (he's a federal technician for the guard but is paid by the feds and not the state). What started it all was when he found out he was heading back overseas next year. He was in a car accident last Christmas with no injuries (amazingly since a semi ran over him). Not a word about any physical problems until deployment came up. Now he's getting out because he found a quack that says he can't work anymore due to a back injury. Funny thing is he is all the time bragging about the four wheeler accidents he has had since this all came about. He got the letter from his job the other day stating that as of Nov 13 he no longer has a job. He thinks he's getting unemployment from them but from what I understand if you are let go from your job due to no longer being able to perfom said duties due to medical reasons you can not get unemployment. He's already terminated his rights to two other children. He has our son and two other children to support (that we know about, possibly more). So, how do i make him pay support if he has no income if he has "no choice?" Thanks in advance for your help!

I just noticed the area you're in. You should have a KLA location in your area and as far as a attorney ask around for a good one near you.

my ex husband just got his disability approved after 2 years of waiting and my son gets to draw 646 a month plus they are taking 241 a month out of his check each month for child support...but my son get to draw off of his disability, but it did take 2 years and I also got the back pay which was 5000 that he owed in child support taken out of his settlement check.

Opinions are like AsSholes, u know the rest. U r a low life trolling for ur own personal gain$$$$$$. Mr old attorney retire!!!!! U r a dead beat, has been...everyone feels sorry 4 u. Everyone at the court house knows n including the Judges ur an asshol! We just tolerate u n until u disappear. Take the hint!!!!!!!!!

I think if your husband is receiving disability, your son my be entitled to a check as well. Maybe even some medical assistance. Not sure, but I know someone who receives Social Security Disability (due to injury) and his son also received a check. My father-in-law receives it as well and his daughter also gets a check because she is under 18. I would call the Social Security Board and check with them. Good Luck!

Yes if a parent is disabled then their child can draw a check from social security.

So, if and when he gets disability is he responsible for signing our son up or am I? If he is responsible I don't trust him to have the checks going to our son...he'll send it to himself and never tell us about it. But i also don't trust him to tell me when he gets disability so I can sign him up. Thanks for all your answers.

how do u get ur check because i draw diablility and my kids gets ktap and i have tried to draw a check on them i get no child support from either one of their dads and cant draw a check for them off my disablility what should i do to get a check from mine??/

um not to be smart but um THAT IS WHY U GET KTAP!! cuz u dont get child support from the dad! if u were gettin child support u wouldnt get ktap!

If he does not have custody of his son, I don't think he would get it. I would assume they would ask him if he has any minor children. You can probably call up there and see if your son is entitled to anything if the dad is receiving benefits. They won't tell you anything about him personally, but they should your son.
