Sounds like a clean shoot to me. A concerned citizen calls to report a crime. In the process of getting more information to pass it along to the proper authorities, one of the suspected burglars begins an agressive attack.

The concerned citizen defends himself.

That is the EXACT REASON most states have adopted right to carry laws.

We can't let the criminal scum run around unfettered or our society is lost.

We had a burglary in the neighborhood today. A couple of young men came out of the house with bags of stolen property and took off in their newer white Honda CRV. A neighbor followed them, got their licence number and tried to stay on them while police came. Police did not come and they ran red lights, sped, made illegal U turns, getting away. So, what if they attacked the neighbor following them to eliminate the witness. Should he let them break his window and beat him, stab him, shoot him. At what point can he fight back and is he limited in what he can do to preserve himself from danger. My view is when they break the window, he can use any means at his disposal to repel them. He does not have to reason with a criminal who has a pipe and has broken his window. He does not have to retreat to the other side of the truck and hope the guy will not come inside. If he can't shoot once the window is broken out and the attack is coming inside to his person, when can he attack. Mr. Sanchez should be free, without charges and furthermore should be commended for the pubic service he performed.

I think it's funny that you are so ready to believe that nonsense. "Marine" from Los Lunas in the other blog sites said it was him posting as Roadster to see what people would say. Sorry you're so gullible that you fell for it.

By the way, you obviously have some catching up to do. Gabaldon was not shot because he burglarized the propane place, he was shot because he attacked a man that was sitting in his vehicle. That vehicle was an extension of his home and Sanchez had every right to use deadly force to defend himself against death or great bodily harm. You obviously don't agree with that law-too bad. I believe most people would have done the same thing Sanchez did, except people who don't like guns and think that the second ammendment should be revoked.

I hadn't heard this and if the jailer is truthful, he should be sure to tell DA Martinez, if he hasn't, yet. Sanchez impressed me as a vigilante type who had a motive to kill Gabaldon, and would just as soon kill the other one, even though capital punishment is waaaaay too strong a punishment for robbery. I think he had polarized the situation in his mind, thought of himself as "one of the good guys", and so thought he would surely get away with killing Gabaldon--- and Sisneros, too, if he could kill him.

Luke Sanchez capped off a total of six rounds at Gary Gabaldon and Rudy Sisneros. Gary Gabaldon was hit in the face, while Sisneros escaped in the mini-van. Sanchez knew Gary Gabaldon and Rudy Sisneros and decided to mete out some street justice after recognizing the two. Luckily, Gabaldon and Sisneros had several good witnesses, a rare commodity these days in small town Belen, NM. The local District Attorney admittedly stated that his office is low staffed but noted he will not compromise the Gabaldon,s murder. A crime scene van pulled up to the scene of the murder and spoke to the murderer Luke Sanchez, paramedics, and several witnesses including a man who saw the whole thing from his patio. The man was so terrified that he would not walk to the scene of the accident. Police had to interview this witness in his home right next to the crime scene. Family of Sanchez are organizing a petition stating Gabaldon had a weapon and the murder was self defense, but according to witnesses and police at the scene, Gabaldon never branded a weapon, nor did he ever lay a hand on Sanchez. According to one of the jailers, Sanchez told him that Sanchez was angry that he was unable to kill the other individual driving the mini-van.

Give Sanchez the benefit of the doubt. The other guy had a history of burglaries and other crimes; he was under the influence; and he was in close proximity to Sanchez, quite likely to place him in fear for his safety and life. This guy didn't chase anyone for 2 blocks to shoot him in the back. He shot someone who accosted him, during the commission of felonies, on a dark, deserted roadway. I think we should give him the benefit of the doubt.

PS I don't mean to sound heartless, but if more of these types of things happened to crooks, including getting shot by a woman they were trying to rape, it might actually DETER criminals! Let's start feeling sorry for the VICTIMS OF VIOLENT CRIME, and not the survivors of it. I was KNIFED, and beaten and kicked severely about the face and head by TWO FELLOW GIs while stationed in Germany. If it hadn't been for two MPs from the 503rd at Vogelweh (Pulaski Kaserne, Kaiserslautern, Rheinland-Pfalz District- July 5, 1971) who happened to come by, I wouldn't be sitting here telling you this story.
I wished I had had someone like Sanchez PACKING alongside of me, or that I had my M16A1 or M1911A1 on me!

Don't believe roadster2000! He is posting contradictory information on all the other related blog sites! Read them for yourself. He has no inside information. He thinks he's a detective or something! Maybe he should change his name to Scooby-Doo! I have seen the petition myself and he is lying about what it says. Paul Caputo of Rio Rancho is the one that started the petition-it said so on the news! I guess he has never heard of slander or defamation of character! In my opinion he is trying to tamper with a potential jury pool. The FBI can trace the ISP numbers of every computer in the world. I am sending a copy of all his postings to them and the DA's office.

roadster2000 posted this on a different KOB.com discussion. Judge his honesty and inside knowledge of the case for yourself. http://www.topix.com/forum/city/belen-nm/T7SN...
First he said that the bullet exited Gabaldon from the front of his neck and now he says he "was hit in the face". Sounds to me like he can't keep his story straight.

The bullet entered Gary Gabaldon,s head at a 45 degree angle and emerged to the front of Gary,s neck just left of his larynx.

Luke Sanchez was able to cap off six rounds at Gary Gabaldon and Rudy Sisneros that cloudy night in Belen, NM. Sanchez hit Gary Gabaldon in the face then ran him over with his 98 white dodge pickup truck. Rudy Sisneros was lucky to escape from this murderer with his life. Sanchez knew Gary Gabaldon and Rudy Sisneros and recognized the two that night. He then decided to mete street justice because Sanchezes cousin Reiyna Trujillo told Sanchez that Gabaldon treated her badly. Paul Trujillo, Reiynas father also called Sanchez that night and ordered him to kill Gabaldon. Paul Trujillo is a local wannabe attorney for belen and advised Sanchez he would help him with the legalities of this case. Paul Trujillo was seen at the courthouse advising Sanchezes sister of what to tell the media after the court was ended. Paul Trujillo is trying to help the Sanchez family and is also assisting with the petition to let Sanchez free. The petition states Gabaldon branded a weapon but it is a lie Gabaldon had no weapon with him. Sanchez killed Gabaldon thinking the media would not get involved but so far by the footage Sanchez has lied about Gabaldon branding a weapon and Gabaldon breaking out his truck window. A crime scene van pulled up and spoke to the murderer Luke Sanchez. Sanchez told the state police, paramedics, and several others conflicting stories about the murder he committed that night. One witness saw everything from his patio that night and was too terrified to speak with police at the scene. He made police enter his home to speak with him. Sanchez does have an honorable discharge from the military. But was discharged for medical reasons. During his term in the military he was ordered to speak with a pychiatrist after he almost killed a fellow soldier after a disagreement during a poker game. The pychiatrist stated Sanchez was a liability and ordered him discharged. Sanchez returned to Belen while he recieves disability checks from the Government.

What evidence is there that Paul Trujillo ordered Sanchez to kill Gabaldon?

" The pychiatrist stated Sanchez was a liability and ordered him discharged. Sanchez returned to Belen while he recieves disability checks from the Government. "

And what evidence is there for these two preceding sentences?

Just curious.

I didn't say I believed it. Frankly, though, I don't think the poster is "Marine", from Los Lunas because his posts under that name have misspellings and grammar problems, tangled syntax---I just do not think he has the same level of intelligence as this "Roadster" poster. It will be interesting to see if truth of any of Roadster's statements is borne out in court, though.

Obviously I think it more likely that Sanchez shot Gabaldon for other reasons. Maybe Sanchez just panicked and shot Gabaldon because he approached Sanchez' truck. Or maybe because he thought he had a good chance to get away with it by claiming self defense. And that it would make things easier for his cousin's daughter. I don't know why he did it, but his self defense claims don't hold water yet for me. We'll see if he changes my mind by his court testimony. I do know Sanchez lied to the cops about the license plate; that's rather damning IMO.

I don't know whether the information Roadster posts is true but I think it is unlikely Marine and Roadster are the same person. Roadster shows considerably more intelligence in his/her writing.

Just read again roadster2000's last post. It too has many misspellings, etc.

But it still seems more intelligently written than what I recall of Marine's stuff.
But that has been awhile.

Just hafta wait and see. Anyone recall when Sanchez is due in court?

I agree with you, where is this person's proof? They have yet to offer any, just wild unfounded accusations. What does that tell you? I think it's safe to say that they are probably a friend or relative of Gabaldon's that is upset over all the opinions in favor of Sanchez IMO.

You belong in the same class as soft landing, a nutcase.. I suppose Paul Trujillo also ordered Gary Gabaldon and Rudy Sisneros to break into that place of business, or do you have an answer for that too. Why? Because Gary was such a good guy... Give me a break and get off the crack..

Daily Horoscope for December 20

Libra

It's another day when tensions are rife and you feel stretched to breaking point. You might even totally lose your temper with someone, instead of merely snapping at them as you did yesterday. Mars stomps into reverse today, so it would be better to clear the air now with a row, and then forget all about it, rather than allowing bad feelings to accumulate and fester inside you.
