This guys a fool! Of course a 10 year old could be perfectly capable of committing diliberate murder.
Who in the he!! is this attorney trying to fool? Not me!
No way, this is a 10yo child. He doesn't understand the implications of the crime he committed. This is a DA who grandstanding and using a child to achieve his goal of reelection.

My 'no way' was aimed at the actions of the DA. I think that 10yos understand what killing is but not what it really means, the gravity of it. This DA is overboard IMO!

Perhaps there is a mental problem (the usual defense/excuse) and I'm sure a psych eval has been or will be performed.

And for the 'abused' angle the next poster said, that too may be true but I've not read anything credible on that 'also overused excuse'.

Could a lighter sentence for murder be doled-out because of genes linked to violent behavior? This is where a forensic psychologist could review the young man's past history and ask the court to take into account that he may have been a victim of a weak-link in the chain of DNA that is the make-up of all living things...

I find that some of the facts are missing from this story.
One is not able to make a informed decision without all of the facts. I implore the reporters to please get all of the facts so that the readers will not hang a person based soley on their emotions.
Yes, it is possible for a 10 year old to murder another person. They can be influenced by many things, for example: television, electronic games (WII, Playstation, XBOX), abusive parents, bullying, medication.
So I request again.....Reporters, PLEASE get the facts straight.

Did the boy really do it or did the mom kill the childs father and blamed it on the boy?
I am more then certain the boy is the correct age for such a crime.

I stand by my earlier post that this DA is grandstanding. This is a child and something triggered (pun not intended) the crime. At his age I think this is one of those RARE times when a child can be rehabilitated. He should not be let go but rather put into an institution and seriously tested until it is determined by a panel that he is psychologically stable and can return to society. And such is a rarity for me to promote as 'mental health' issues have become as excuse all to often, even though they may well be the real underlying reason in some cases. I firmly believe that at his age he didn't have a full grasp on what he was doing. But only a psych eval at best will reveal the why of what he did.

I agree with that, however, unless he is charged as an adult, he will be let loose, with his record sealed, in 7 years.

While it's a heinous act, no 12-year-old is an adult so matter what act he or she commits. I'd like to be on the jury...so I could throw this case back in the prosecutors' faces.
