Congress Needs to Stop Bickering and Pass Domestic Violence Legislation

Full story: voices.yahoo.com

The federal reauthorization of the Violence Against Women Act has fallen victim to political bickering, with the House of Representatives and the Senate refusing even to consider the versions passed by each other, the Idaho Statesman reports.

Idaho Republican Sen. Mike Crapo, a sponsor of the Senate version, said it was pure gridlock. He's not sure how the standoff will be resolved. "I think there's a bit of a stare-down going on there with the House leadership and the Senate leadership," Crapo said in an interview. The gridlock is another sign of Congress' inability to do much of anything but bicker this year. This is the third time VAWA has been up for reauthorization since 2000 and it has never been controversial before. The landmark 18-year-old law includes measures to help victims of sexual assault and domestic violence. Among other things it provides short-term housing for abused women and grants for law enforcement staffing and training.

I haven't read the whole act. I am sure most of it means well, but a part of it criminalizing "cyberstalking" has justly been declared unconstitutional by at least one federal judge.

In that case the defendant was arrested and jailed by the FBI for tweeting open messages deemed to be "cyberstalking." You can read the case by searching for "william cassidy" or "tweets were free speech, not cyberstalking."

Although the messages irritated the so-called victim, she had the option to ignore them. They were not sent to her email address. She had to voluntarily open them up to see them.

Whoever stuck that stupid criminal statute into VAWA does not understand the Constitution of the United States and is an enemy of freedom of speech. It's idiotic and tyrannical to try to use the criminal law, especially a federal criminal law, and in the instant case a felony, to try to impose a civility code on the people of the United States. Plaudits to Federal Judge Roger W. Titus for striking down that monstrosity in VAWA as a violation of the First Amendment.
