Bella Vista POA and Mayor are being sued

The POA's Board of Directors recently met (behind closed doors of course) and discussed the option of foreclosing on members homes who were late on their water bills. I do not believe this is public knowledge yet. A person naturally requires food, shelter, and water to survive and the Bella Vista POA is now looking at targeting two out of three of these items. It's practically genocide and yet tens of thousands of citizens are forced through unscrupulous means to join this pathetically amoral organization!

The membership gets nearly nothing for the millions of dollars they pay in assessment fees, and here the Board continues to conspire to take everything away from the families they are supposed to be serving. The POA Board of Directors are a bunch of spiritually-bankrupt lowlife scum. The entire operation needs to be disbanded and the amenities brought into city control. Can anyone name a single other city in the Continental U.S. whereas a family can literally lose their home simply for being late on a water bill? There seems to be no limit to these people's greed.

So Bryan Vernetti,was supposed to terminate his relationship with the ACC. which enforces the protective covenants and coordinates with the POA? That's odd. Bryan Vernetti was the lawyer who wrote me re my complaint about the ACC entering my yard without permission, in order to address a chicken complaint when they did not have the authority to do so. That was the tail end of the winter of 2010.(See the chickens thread on this forum.) Isn't that illegal? Don't lawyers lose their licenses over that sort of thing?

Sorry for your troubles but rest assured that Bryan Vernetti and Tim Hutchinson (Bella Vista's legal team) are both pretty trashy attorneys with little respect for the law.

Lots of Realtors won't show property in Bella Vista because of the corrupt POA, Water Dept., and Police. Even those of us who don't live in BV know that Bella Vista is a nasty little place with lots of dark secrets... Every person in a position of authority needs to be removed and re-start the process. The POA office is a JOKE and should be sued for discrimination against certain residents! Good luck getting water service that's legitimate; I question their billing practices and highly suspect that many of my clients have been gouged. Is it any wonder that Bella Vista has a blanket 20% lower property value throughout the city - homes in Sulpher Springs sell faster and for more money... While their at it, sue the POA for ruining property values too!

Bella Vista Ordinance 2007-01 is the first city ordinance enacted by Frank Anderson and the members of the Bella Vista City Council

Section I Chapter 2 is titled "ADMINISTRATION"

Section 2.01 is titled "Council Meetings"

Item(9) is titled "DUTIES AND PRIVILEGES OF ALDERMEN AT CITY COUNCIL MEETINGS"

Item (d) is titled "Financial Interest" and specifically states "No member of the City Council with a direct or indirect financial interest in any items before the City Council shall participate in the discussion of or voting on such matter."

As we all know, every member of the Bella Vista City Council (by virtue of residency) maintains a financial interest in the Bella Vista Village POA.

By law Council members are prohibited from "discussing" or "voting" on any item involving the Bella Vista POA.

PLEASE CONSIDER HOW MANY TIMES THESE COUNCIL MEMBERS HAVE DISCUSSED AND VOTED ON MEASURES INVOLVING THE POA...

STREET MAINTENANCE CONTRACTS
PROVISION OF MUNICIPAL POLICE FOR POA LAKE PATROL
PURCHASE OF USED STREET EQUIPMENT
RENTAL OF EMERGENCY SERVICES BUILDING
SANITATION (TRASH) BILLING SERVICES
CONTRACTED STREET REPAIRS
PROCUREMENT OF POLICE VEHICLES & EQUIPMENT
WATER FRANCHISE AGREEMENT

THE LIST IS PRETTY IMPRESSIVE.

OF IMPORTANCE IS THAT EACH OF THESE ACTS HAS BEEN IN STRICT VIOLATION OF BOTH LOCAL AND STATE LAWS.
