That's exactly the point. He was not high at work, nor did he give them any reason to test. He happened to get hurt and testing is standard procedure, hence, he tested positive. Something a lot of folks don't seem to realize.

Did anyone see where the Michigan Supreme Court is going to hear this case now? I hope this guy wins. The fact remains that Wal Mart has to follow the laws of our nation, not just the state laws. Federal law still bans the possession and use of marijuana. If you disagree with that, work to have the federal laws changed.
