Why would they test any of the passengers? When there is an accident, the authorities are interested in the person or persons controlling the vehicle. All the passengers could be sleeping, drunk, illegal aliens, children with no license-- doesn't matter. It's very likely that none of them were in the condition to drive- but one of them did, and it resulted in a wreck. If any of the others had chosen to drive, it very likely would have resulted in a wreck. I am sorry for your loss. I am sorry for anyone who has ever lost anyone to a drunk driver. I am, however a little thankful when it's only the actual drunk driver injured/killed by their own actions rather than taking any innocent person or family with them.
