Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail. The JCT letter makes clear that Americans who do not maintain “acceptable health insurance coverage” and who choose not to pay the bill’s new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.

n response to the JCT letter, Camp said:“This is the ultimate example of the Democrats’ command-and-control style of governing – buy what we tell you or go to jail. It is outrageous and it should be stopped immediately.”

Key excerpts from the JCT letter appear below:

“H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.”[page 1]

“If the government determines that the taxpayer’s unpaid tax liability results from willful behavior, the following penalties could apply…”[page 2]

“Criminal penalties

Prosecution is authorized under the Code for a variety of offenses. Depending on the level of the noncompliance, the following penalties could apply to an individual:

• Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.

• Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.”[page 3]

When confronted with this same issue during its consideration of a similar individual mandate tax, the Senate Finance Committee worked on a bipartisan basis to include language in its bill that shielded Americans from civil and criminal penalties. The Pelosi bill, however, contains no similar language protecting American citizens from civil and criminal tax penalties that could include a $250,000 fine and five years in jail.

“The Senate Finance Committee had the good sense to eliminate the extreme penalty of incarceration. Speaker Pelosi’s decision to leave in the jail time provision is a threat to every family who cannot afford the $15,000 premium her plan creates. Fortunately, Republicans have an alternative that will lower health insurance costs without raising taxes or cutting Medicare,” said Camp.

Oh it gets better. The Hispanic Caucus has said they will not vote for it if it includes a provision to check citizenship. Then they also will fund abortion with an option. So it would appear Joe Wilson was right.

At first the bill <insurance or jail> provision appears just insane.

Then I realized Pelosi is just "paying off" some insurance_industry pals by assuring them Joe_Shmo citizen WILL buy their overpriced/under_performing product.

Did we not warn of the insanity of government health care? Did we not warn that anything the government gets its hands on turns into a bureaucratic nightmare? Yet you wanted government health care and here it comes. You will be paying for illegals, abortions, and going to prison if you refuse to do so.$15,000 a year will come out of the pocket of the average American family or they will be heading to prison. I don't know about you but that seems like a tax hike and something that would break many families who are just getting by. So, still wanting your government health care noshell??

This health care plan taking up so much TV time is just a way to side track the American people...keep us looking to the left...so they can really slap us on the right. We never heard anything about ammo having an expiration date, already done..they do not have to worry now about gun control. no Christmas Tree in the White House this year, Holiday Tree ! Mr. Logic, this article was rather misleading. That "$15,000 premium" refers to the Exchange "reference plan" in 2016 and is the quote for a family of four with an annual income of about $100,000. I believe that most people in that income range have medical benefits where they work.(This information is embedded in the article to which you posted a link if you click on "Congressional Budget Office" near the end of the article.)

Right now, I am paying over $6,500 per year for coverage for just myself; if I covered my husband, it would be over $13,000 per year, and if I get sick my insurance company can drop me.

I am sure there is plenty in this bill that legitimately deserves criticism, but I think the article you cited is filled with half-truths and misleading statements.

One thing that upsets me more than a forced medical plan is that this year, the White House will not be setting up a Christmas tree. It will be called a Holiday tree and no religious items are to be placed on the tree.

Hey Ex-vol. My ultimate problem with all of this is it does nothing to control costs. All it does is transfer the expense of health care from the citizen and insurance companies to the federal government. Then we still end up paying the out of control bill, just in the form of taxes and premiums. Nothing in here addresses the cost of health care and getting that down. From tort reform to true competition. If you went after that then you got me vote.

This whole thing has never been about the cost of healthcare.

The three major participants fighting this "civil war" are not concerned with cost or quality of healthcare, never have been.

The democrat and republician politicians are fighting to beat the opposite party in a politicial battle.

obama is fighting to gain more control of the people and set the stage for bring up a national police force while preparing the country to be handed over to the one world government without any noticeable opposition.

That's it.....nothing else matters.

The citizens are only suffering the consequences of this war.
