you gotta shoot once to warn family!
then shoot the robber dead since it could be a family member you need to left off a round first and if the person doesnt flee you are safe to ensue action because you have threatened with a bullet and the person in your house has threatened back with equal or greater power obviously they have something for that warning shot you let off and they arent running away.. therefore your life is in danger happy killing! |

What happened with Jim's trial?? Haven't seen anything on here, or Watseka paper, or the Kankakee paper??
Hope him and all his family doing ok - will keep checking on here.

I have not heard what the outcome of this was. I live in the area and will try to find out. I do not know Jim personally but did follow this when it first happened and then the news just dropped off.
As far as Jim’s actions – I WOULD/WILL DO THE SAME THING. Come on my property day or night with bad intentions and there is a 100% probability you will leave my property in a body bag. |

After almost 3 years Judge Kinzer suddenly decides 13 days before the case is set to go to Jury that he has a conflict of interest?

Atty Sacks represents that, in addition to Judge Kinzer settling the estates of both of the Defendant's parents, Judge Kinzer - when he was in private practice- handled a real estate transaction for the defendant in 2002, and that there is presently pending a civil lawsuit against the Defendant by the family of the victim in this case. On these bases, the Court concludes that there may be the appearance of impropriety in this case being handled by Judge Kinzer either at a jury or a bench trial, and the Court recuses itself. Case stricken from March, 2009 jury calendar. Case referred to Chief Judge Elliott for re-assignment. |

Completely irresponsible and unprofessional of Kinzer. Maybe he should consider going back to private practice where he can screw up all he wants.
After reading the case narrative on http://judici.com/courts/cases/case_history.j ... all I can say is what a joke. This thing has dragged on and on and on. The only winner will be the defense attorney as Jim gets bled dry financially. I think $1500 per appearance would be a good guess not to mention all of the other fees. In the mean time Jim’s life has been upside down since 5/22/06 when he was charged. This whole farce of justice is making me believe that if I ever find myself in the position of killing an intruder to protect my family, my life or property that I may do better to not call the authorities and just make any evidence go bye-bye. Judged:
1 Illinois law specifically has an exception to the use of force law for force that may cause great bodily harm or death in the defense of a forcible felony. Burglary is specifically listed by Illinois Law as a forcible felony. According to the minutes of this case on the very first court date it says "State proffers defendant has no prior criminal history. Pursuant to burglary of his tool shed, defendant shot alleged burglar, and victim Heather Todd was killed." The State acknowledged that he shot the "victim" pursuant to a burglary, a forcible felony, which is the very exception to the use of force law. They have no case. |

Jury trial will be second week of Nov. Judge Kick from Kankakee will preside, but it will be in Watseka. They would appreciate all the support you could offer. I know the wife,and after 3 and 1/2 years she is amazingly strong, and believes when the truth is finally made public people will be outraged at the way this case was handled.

The consequences were deadly for this young lady. A life of crime is not a good road to be on. This is a example right here.

People are so dumb i hope this happens to your family cause mr. brown was wrong. I would never kill someone for stealing no matter the price it can be replaced. The point is he coulda stopped them now he took something that will never be able to be replaced. I want you all to think about something. I personally know about 80% f the teenagers from around gilman and i know the steal farmers gas or steal beer or go mudding in their fields. I want you who have those kids to still agree it was okay for some guy to put your family members brains on the ground over a rachet set.

Where we live is mostly our choice. Live in town and you receive city services (you probably will find complaint) fire, police responce faster. No every one want to live in town so you live where you want, it is your right. The basic question I have is does Mr Brown have any remorse about the shooting. Some will say he should not, as he was correct.

No one knows what they will do until they are faced with it. When someone tries to steal anything from you and knowing that police are at least 1 hour away from you, you shoot to protect what is yours.
