... We have received legal advice from our council about all possible options including condemnation and reacquiring the property, but we are restricted by N.C. law not to pay in excess of fair market value.”
legal advice from counsel is probably what he meant, unless there is a council of legal experts |

man this is great news. this pack of packs stopped the council dead in their tracks. seems they have an abundance of closed door meetings here lately huh ?

I hope the Packs win this suit. This is such a money-grab for Coleman who already has millions from the sale of the Asheville Mall and the new condos on Battery Park. He does not need to gum up Pack Square. I hope the lawsuit ends this, else I think the property should be condemned and taken for eminent domain. He is not being a good citizen. Downtown development is great, but not at the expense of a public park. There are plenty of options out there.

All that happened here is that the commissioners decided not to offer millions to purchase the property back until they find out what happens with the Pack lawsuit. They hope that the issue will find resolve one way or another there so they do not have to figure out how to handle this mess. |

It's easy offer Coleman fare market price "about the same that he bought it for" or we'll take it under eminent domain... either way we will get it back and he can get some money back or lose it all. I'm sure it won't break him and it's probably not the first time he has lost money on a deal. If this was fare to sell in the first place I would have bought land in Central Park and built Condos there years ago.

I sincerely hope they take the whole donated property back and put in a trailor park---lol...nothing that drastic, but folks have become so damn compliant on the fact that there is a park there---and will be there forever..(I sincerely hope so) BUT in the laws eyes, it should resort back to the family--- and I am serious on that point---let the tap dancing begin!! I bet the commisioners are backstabbing eachother on this one. They flat arse screwed this one up. |

Did you see the news atricle on how many of the Commissioners received campaign donations from Coleman and his employees? |
|
So, what happens if the Pack family gets the land back? I'm pretty sure they're not going to give it back to Buncombe County, so what IS going to happen with it? Since they don't live around Asheville, I'm also pretty sure that they could care less what the concerned citizens want.
Oh, by the way, since it was a "sliver of land" that the Coleman bought, will ALL the Pack land go back to the Pack family, including the land for the park? If it does, say goodbye to the park. |

Please also mention that PSC employees donated to Gantt. Also note who his campaign treasurer is. Fair is fair. |

Yes, I didn't catch all the news but I spoke with someone that told me about Gantt. None of them are squeaky clean. I am of the opinion that the voters should clean house in both the Buncombe County Commissioners and Asheville City Council.

Someone is always going to try to make a big deal out of anyone who donates to a candidates campaign. You can look at any candidate and fabricate a story about some donation. It takes donations in order for anyone to run a campaign. Signs, ads, flyers, etc. are expensive. You could say alot of non-profit employees donate to Holly or attorneys donate to Gantt. Anyway assume whatever you choose but without donations, only those who can afford to finance their own campaign would be able to run. Coleman also gave money to PSC for the park but no one mentions that.

I think criminal investigations of bribes and gifts of money to some of the commissioners should be looked into. Bill stanley should not be allowed to run for another term. He ehould be Bobby Medford future room-mate in prison.

Possibly The Pack Family will offered the reclaimed Park Land to be sold to the highies bidder? May be the City, or may be to the County or may be to Stewart Coleman or some other developer? The motive may be the Pack's and only the money. They have an attorney that say's he is working for FREE. I have never known an attorney that works for free today; and not get paid tomorrow for the free work proformed yesterday. The property will revert to the Family. Then they can tell everyone (Pack Square Conservancy, County, City) to get off their property, unless that person wants to BUY IT! |
