Well it appears the employer of the diver killed at the Paris water treatment plant has taken the blame for the death and received a $64,000 fine unless they appeal.

Have not hear about this....what happened? was it Negligenceon the city's part or the boss?

OSHA did not comment on whether the city had any blame.

The agency's press release addressed only the safety violations for which International Diving Services of Arlington.

"The employer failed to ensure appropriate safety procedures were followed for entry into a permit-required confined space and failed to control the hazardous energy that ultimately took this employee's life," said Stephen Boyd, OSHA's area director in Dallas.

The Paris news reported that "Monday, May 12, he descended into a water storage tank in Paris, and lost his life. According to police reports, he drowned when the storage tank pumps turned on, pinned him and sucked his breathing apparatus away."

The company appears to be at fault- Sources that work for the city reported that the dive cerw returned to the water plant after hours and continued to work without anyone knowing they were there.
This would also explain why the city was not cited. Some companies are more worried about MONEY than Safety.

"PARIS, Texas (22 May 2008)— Othel Smith's friends say he could not wait to get out into the world, get his diving license and become a professional diver.

He served time in the Coast Guard on the cutter Spencer and told his Coast Guard friends in Boston he was excited about a career in diving.

He found work with a contract diving company, International Diving Services in Arlington."

The City could have easily prevented it from happening however. Why was there not even a city supervisor on the job while these people were on city property? Did we not even know they were on site?

While I agree from the information I know that the city was not at fault, they cannot be cited by OSHA -- municipalities are exempt from OSHA.
