Possible Student Discrimination

Is it a case of discrimination? A handicapped student at East Central University in Ada is being told he's a threat and can no longer live on campus.

That sucks. Put him on the bottom floor and let him ask his neighbors to let him know if they need to evacuate.

There is no possible about this, this is discrimination. What happen to reasonable accommodation. It is the responsibility of dorm proctor to insure all evacuated in case of disaster also the local fire department should be notified that there is a student who needs assistance evacuating in case of fire. This college offers a degree in vocational rehabilitation which is a degree for counselors to insure all persons with disabilities lead as productive a life as possible. This is wrong in all sense of the word, this young man is being discriminated against. He wants to earn a degree to enter a work force that for too long has discriminated against persons with disabilities

If this was the policy when he moved in he needs to follow the rules. Come on people wake up and quit whining when something does not go in your favor.Policies and rules are put in place for all!

Everyone is suppose to have an equal right to go to school. When he moved in the officials of the school knew he is handicapped. Why wait until after he is settled into the first semester and then tell him he is a "threat" If anyone is breaking policies and rules it is the school officials not Jackson. Shouldnt they have handicapp accomidations. They do make special arrangments at some schools if the person has an aide or will have one assigned to them through the state to follow them at school and to help them get ready for school.

Shame on ECU, you would think a university would of been smart enough to realize not every student can walk on two legs,time to get off their lazy rears and get with the times and have a handicap dorm area. Good Luck Joshua and if all else fails and ECU does evict you..sue them make enough money to go to a real college!!!!

The fact of the matter is the guy lied on his application. He said he was fully able to get into and out of bed unassisted. It turns out, the guy has an aide that comes in for short periods morning and night to help him out of and into bed.

The problem lies in the intervening time between night and morning. If there were an emergency, he would be unable to evacuate. That creates a very bad situation where the student could die. Policy requires him to have an aide during those times in case of emergencies.

This is why he's being asked to leave the dorms. ECU doesn't want the guy to die.

This Is a Travesty of The Higher Educational System!

I work in Post-Secondary education with emphasis primarily upon adults and have done so for the past 24 years. I have a very sound idea of what I am talking about!

Any student on our campus, after acceptance, becomes our responsibility to care for as well and effectively as possible, even if that includes seeking help for a student that is physically impaired. Education should not offer limitations to any student's aspirations and that is exactly what East Central is doing!

Ms. Berty, hope you are ready for a litigated process! They do NASTY most especially when you are found to be GUILTY!

I see this situation as a total outrage and strongly agree that Discrimination is the case in point. It seems like East Central is all about trying to minimize any liability that may it may face, should there be an incident identified to be an emergency, ALL at the expence (mental, emotional, & physical) of Mr. Jackson!

Joshua, if you read this, take your grievance to the attention of the Oklahoma Board of Regents and any organization / law offices that represent those that are physically impaired/limited: Americans with Disability Act.

This is not right!

This is NOT Possible Discrimination! It is Actual Discrimination. This is a clear CIVIL Rights violation. This guy could successfully sue not only the school, but the officials that did this. Why would these school officials want to create a situation where they have a personal finincial risk?

Joshua, contact FIRE and let them bring justice to Ms. Berty's office.

You are a complete and utter idiot. Have you read my housing application? NO. You haven't! Why not? Because it is confidential. The only section that is asked of ANY student is whether or not they require a private room so their hired medical staff can perform their tasks in private. Any section pertaining to disabilities is whether or not they need a wheelchair accessable room and the afore mentioned criteria. And how would when my medical team visits and when they do not? Next time do a little reasearch before you make a fool of yourself in front of the entire world.

This is not discrimiation. I am an educator so I know most of the policies that the schools have to go by. As long as there are resonable accomidations made for him its ok. But it sounds like he needs more then resonable accomidations. The school has to think of other students. Not just one. If they ask other students to help him out, which I am sure that someone would not mind, they are risking their own lives in the process. Now is this right that he puts other peoples lives at risk including his own? Plus the school would be responsible if one of the students got injuted or worse. There are other places that can help him out with transportation, schooling, and medical aid. Like the Department of Rehab. DHS and other places he just has to look

You're also required to agree to all housing policies, which includes sections on being able to respond to emergency evacuations and not being a danger to yourself. Fail to follow the policies that are in place to keep you alive and you will be removed for your own safety. He stated that he was completely capable of following all the policies when in fact, he wasn't.

The pertinent section of all the housing contracts:
"Each resident is expected to conduct himself/herself in a manner acceptable for community living including adherence to the policies stated within this contract, the policies outlined in the East Central University Student Handbook and all Housing Policies. Residents, who by their actions, violate University and/or residence hall/on-
campus housing regulations, create undue disturbances for other residents, or who refuse to cooperate with other students and with residence hall staff may be subject to disciplinary behavior including, but not limited to, being dismissed from the hall and may, at the discretion of the Dean of Students, be recommended for dismissal from the
University.

I understand and accept all the terms and conditions of residing in any of the on-campus housing facilities as stated in this housing contract, the ECU Student Handbook, and the Housing Policies. The Housing Policies and ECU Student Handbook may be picked up in 155/102 Administration respectively."

Next time you should read a contract before you sign it.

Annie, you are confussing USC 20 with USC 504. The term "resonable accomidations" is no where in civil rights law!!!

Moreover, every single judge in the United States of America says your interperptation of USC 20 is wrong. Go back to Iraq, where you belong. Here in America, we believe every human life is EQUAL and EQUALLY precious! Moreover, there are not some humans more equal than others!

THE SCHOOL SHOULD DO THEIR BEST TO TRY TO ACCOMMODATE HIM AND ANYONE ELSE WHO WANTS AN EDUCATION WHO HAS A DISABILITY!!!
