I called Judge Fallons office last week - they do not get involved in the timeliness of payments from the various lawyers to their clients.

To puzzled - if your MI case was settled in August or September '09, then you only are going to get one payment in full. That was stated at a vioxx conference.
Keep calling your law firm for answers !! Unless they submitted your case through another law firm like SW and are waiting for a check from them - then Weitz should have your money!.

Would any of my MI friends be willing to tell me how much their lawyers are charging them for "expenses".
I understand the 32% and the 1% but I'm being charges almost $10,000 for "expences". I understand we will all have different amounts, but $10,000 sounds a little high to me.

Did they say what expenses? They should list them. Was it a simple case? Did they have to do anything extraordinary?

Cliff, mine were a little less than $1700. I would guess that misc expenses (office expenses) would amount to somewhere between $500 and $2,000-$2500.$10,000 is outragous. I would demand an ITEMIZED list of every charge and payemnt.(My atty sent that to me with out my having to ask!)

My firm is charging me also around 10,000 $ for " shared cost " i contacted the claims admin. at brown greer they are looking into it and want to contact me again on friday.
Your firm would not happen to be in CA ??

May I suggest to CONFUSED HOOSIER, STRESSED IN ALASKA, CLIFF and anyboby else with a lawyer who is trying to STEAL $10K of YOUR settlement-START NAMING NAMES!! I don't think any of you have posted who your attorney is. Could be (and I hope it is) you all have the same scumbag lawyer.

I'm guessing: 1. This attorney may not like being trashed on the internet and 2. Other folks with this atty will hopefully double check their settlement recaps BEFORE allowing this robbery.

I get the feeling these attys are watching these blogs and know what's being said about them. Just a thought. What's everyone else think??

I know there was a gag order we signed, but I THINK it was only about how much and how many points and the like. Nothing about who our lawyers are. WHEN we got points or paid. Just no details. I agree with Jerome, name names. (IF you feel comfortable doing so.)

I agree. I re-read the confidentiality clause. Looks like it only pertains to amount of award being disclosed.

We've been naming attys for a long time. I feel THIS one really deserves to be called out!!

Wonder if we can get an opinion from Dick in Ohio?? You out there, Dick?

I still think the people complaining about a $10,000 fee, are talking about the 8% shared MDL fee. If it is 8% of the gross settlement - then we all paid that.

I thought it was 1% we paid....I was thinking it was the 8% the attorneys paid. This has all been confusing....the only thing I am pretty sure of is the MI and IS victims all get the short end of the stick . The good thing is...it is soon to be behind us all...either way. Congrats to all that have received final payments...and good luck to all still waiting. And thanks to all of you for the information and help in getting through this. I appreciate each and everyone of you!

@ concerned i wish you were right but when i take the shared fee and add it back into the sum i got i end up with the figure i thought i was getting so i can tell you for sure it is not the 8 %.
I added to this post how they listed the cost and as you can see the shared cost are deducted extra

They go onto to say in the letter that the shared costs are costs they have expended that have
benefitted all of there clients. These costs include, but are not limited to, filing fees, court
appearances, medical review, postage and copying. And that the costs were then calculated and the
total amount was divided among the total number of there clients who recovered an award under
the settlement.
This is how they explain taking another bite out of our money

It is for the costs that were above the common benefit allocated to the law firm. If the common benefit didn't cover the law firms costs in their entirety the plaintiffs are getting stuck with it to the tune of 3% off the top of their settlement. I have a call into a lawyer that is supposed to get me a straight answer.

Sorry - But that is just WRONG _ and I am sorry for you guys. Why would any law firm have costs above the 8 % MDL fees ?. They did not go to trial - or litigation- of any hold any ebt's or paid for any medical testimony. They did ot travel...and all they had to do was listen to the monthly conferences via a toll free phone number... I hope the Judge cones down on them. And why should you pay for any other clients expenses?
