Question: Which is more important... the preservation of the family unit or the safety and well-being of a child? Most rational minds would conclude that the safety of the child is paramount. This is not just in Miami...it's in North Carolina and EVERY state in this nation...and WE are funding the salaries of those employed to investigate, protect, and mandate.

When are we going to stand up and say no to this abuse of our children? First, they are abused at home, then by the agencies designed to help them!

The National Coalition Against Domestic Violence and the Center for Judicial Excellence are part of a growing national advocacy movement to educate the public as well as litigants, lawmakers, judges, and social service providers about the need for comprehensive family court reform. The Center for Judicial Excellence and their allies worked with California State Senator Mark Leno and others to pass an audit request through the state legislature last July. The California State Auditor is currently investigating the use of court appointees in family courts because of growing evidence that children are being harmed there. The California Legislature is slated to consider additional family court reform bills being presented by the Center and the California Protective Parents Association in the coming months. "We must assess what's happening in our family courts, and that's why I've requested a state audit to take a hard look at the performance and effectiveness of the family court system,'' said Assembly member Beall. Child advocacy organizations throughout the state are beginning to see a chilling trend in the amount of Parental Rights and Responsibility (PRR) cases where one parent (protective parent) alleges child abuse of the other parent (offending parent). Unfortunately, it is all too common that the offending parent is awarded unsupervised visitation or residential rights and responsibilities. HB 1156, a bill sponsored by Rep. Jayne Spaulding (R-Bedford), includes vital protections for those parents who make good-faith allegations of child abuse/neglect, while giving courts guidance in how to proceed with a PRR case that involves an allegation of abuse. This bill is an attempt to truly put the best interests of the child before the best interest of the parent. We believe this legislative fix will help pave the way toward rectifying this disturbing trend that is occurring both nationally and in the state of New Hampshire. The hearing for HB 1156 was held on January 12th before the House Children and Family Law Committee, and the committee heard testimony in favor of the bill from survivors, NHCADSV, Child and Family Services, as well as an attorney who specializes in PRR cases where there has been an allegation of child abuse. The Committee plans to work on the bill throughout the next few weeks. HB 1156 is a 2010 Legislative Priority of NH CAN (NH Child Advocacy Network). NH CAN is a statewide coalition of organizations collaborating to improve the lives of New Hampshire's children by transforming governmental policy, changing budget priorities and inspiring community action. NH CAN is a program housed at and staffed by the Children's Alliance of New Hampshire.
