They can't sue Wal-Mart for violating their own policy. But I am sure if the consumer thinks they can extort a buck out of it, they by god will.

I would be mad as hell, too, if my 10 year-old saw that kind of thing. It might have bordered on humorous had it been an adult, but since it was a kid, all humor was taken out of it in my eyes.

If it were a boy, maybe about 13ish the parents would have never known. I hope wal-mart lawyers fight that in court as well. pretty silly to sue over something that was obviously returned.

Yea you right, if it was me I probably would have laughed and kept it. But if it was my child, I would be upset too. Now I dont about suing. That's Wal-Mart for you. They've got a big campaign going now showing how supporting their non-union strong-arm business practices will help you "live better," and Americans are licking up that Kool-Aid like mad. Bush will probably make suing companies like Wal-Mart an act of treason before he gets out of office, so these people better file while they can.

There's a high standard of proof that Wal-Mart was culpable in and responsible for the contents of the player. I can't see how Wal-Mart could have foreseen this or bears any responsibility for content added after purchase. We don't know when the content was added.

What about going after the WalMart customer who returned it in the first place? Is he/she liable? They probably don't have deep pockets like WalMart but in this day and age of going after sex offenders, lets send the village mob after them.

What they (Wal-Mart) say and what they actually do is another story. If it is returned in working order it most certainly does not go back to the distribution center.

Well, this isn't the first time that returned merchandise gets put back on the shelf to be sold again at a Wal-mart. Maybe this will knock a few heads around.
Ok fine - a 10 year old girl saw it and if I were a parent I'd be ticked off too. But in a video interview when the dad acted like he was about to cry... I just had to look at the slob (looked like he had just got off a drinking binge) and I just knew this guy probably watched that porn oh, 115 times before he called the media. They're definately gonna milk this one for $$$, but you can't blame them, really. Hell, I would.
And yes, I do agree that whoever brought it back should have to answer to folks as well. It's almost as if it were done on purpose,'cause who would be stupid enough to do that by accident?

The store is liable to an extent. They are supposed to check all items when they are returned. Someone did not check this item. I would sue as I am sure that since the store did not check the item in the first place, they don't know who returned it. WalMart gets away with too much at this point, try to take something back to this store with the receipt and they treat you like dirt. Don't even mention if it is an electronic item, that is what is confusing to me. Most stores would not have taken the item back, after a certain lenght of time, they require you as the customer to be responsible for trying to replace an item like a vacumn, tv, etc. The good ole days of good customer service are long gone with this store. Don't even get me started with the way they treat their employees in this country. I have had two children that worked for a few years with this company, and worked many times for no money, after they had clocked out...but that is another story all together. The child that saw these images will always remember them, what you can see with your eyes is stored like a camera in your brain, often coming up when you don't even think about it. I try my best to avoid this store. Hope they do get some money for this, although the damage has already been done and cannot be undone at this point.

I once purchased something from WM... When I opened it, there were yellow sticky notes on the product indicating what was wrong with it... I don't even think they LOOK inside the packages that are returned... they just put them back on the shelf.
