Will this be enforced for service personel as well? If I can't talk on my cell and drive, cops shouldn't be able to either.

I personally would not question a man who is tasked with protecting my life as to his purpose for being on a cell while driving. However, people who would are the exact reason this will never pass. Truck driver and emergency personnel communications are too closely related to cell phones.

I agree that there needs to be a Law passed concerning Texting on cell phone while driving. I feel that the Law if passed should be for all, not just the public. I agree that there should be no exceptions to the Law. I also feel that the Law should cover talking on Cell Phones, unless you have a TALK FREE SYSTEM.

It's one thing using the CB while driving, but police and emergency personel should not be exempt from using cellphones. Just because they are trained service employees does not mean that they are above the laws or can handle a vehicle any better than we can while distracted.

Why?

Is talking to a passenger illegal?

What about putting on makeup?

How about adjusting the radio?

What about eating a burger, or having a drink?

What about smoking?

I think this is all a reach. Not really something I think the government should be deciding for us.

I don't think it's a reach. If they are going to be able to have their phone in their hand, what is going to stop them from texting or playing on mobile net while they drive? I personally think that putting on Make-up, smoking, eating and drinking should all be illegal when driving, because it does distract you.

I only talk on my cell while I drive when I have to, 99% of the time my phone is on silent, in my purse, in the back floorboard of my car. If a call is that important, then pull over... lord knows we have enough parking lots and places to park in this state.

Well it is a secondary offense so I will just follow the speed limit and continue to talk on my phone AND not wear my seatbelt.

The government is out of control with giving us orders.

I can understand no texting....I should be able to talk on my cell phone if I want to. First they say you have to wear a seat belt and now no cell phones...what next??? Last time I checked I pay my car payments, insurance and cell phone bill...

I don't believe an impairment due to alcohol equates to the usage of a cell phone while driving. When using a cell you still maintain the ability to make rational decisions and a far greater reaction time. People have been communicating via air waves for years, I doubt much will change.

I agree apples to oranges...And I think Drunk Driving should have far stiffer penalties then it does....But cell phones??? What's next I can't yell at my kids when they are acting up in the car..HA!!

If a person is able to hold the phone and talk while driving, there will be nothing to stop them from texting or playing on mobile while they drive. Take away the phone & the problem is solved, you might not like it but people have been killed because morons can't stop text messaging or playing on their phones while driving. Don't blame the government, blame those who made these laws necessary.

I will never support any law or ban when the rate of injury is so low. There are over 305 Million people living in the US and the report of injuries due to cell phone use is only 24,000...that rate is so low, I can't believe anyone would even waste time or tax payer dollars on the subject. There are 3.5 million injuries a year due to sports...Let's ban all sports!

As Razor commented this would merely be a secondary offense. Meaning it could not be the cause for pulling a vehicle over. It would only be citable if a primary infraction or traffic accident occurred. What that means in the long run is the use of warrants would be required to obtain cell phone records just so an officer could write a citation for a secondary offense. The people who benefit from this would be insurance companies who would then have an additional reason to raise your rates.
I'm confident this has less to do with public safety and more to do with a politician using his authority for some sort of personal gain.

i see your points but id you take cell phones away them you must make it illegal to eat, talk, look both ways, use a car radio, etc. think of it this way, all those activities require you to look away from the road right? well so does texting so i toss it in there too. however holding a phone to your ear dont take your eyes off the road other than maybe dialing. my thought is all those others (including and especially texting) are far more dangerous than simply talking on a phone. i would even go as as to say that talking on a phone is safer than talking to a passenger simply becase you tend to look at who your talking to. now before you get all bound up im not saying all this stuff should be illegal, im just comparing them
