CR England witholding my final check ???

Is it legal 4 these guys to keep my final paycheck for 45 days? Normally pay is weekly on tuesdays. I knew they would withhold my completion bonus (was a lease operator) but not my paycheck... now im in a bind till I can get 1st check from new employer. Ive always thought the employer must pay for services rendered but it seems England does what ever they want.

HOW ABOUT THIS, ENGLAND SAYS THEY PAY FOR LISECING,PERMITS AND ETC AND ALL THEY DID WAS INCREASE THE VARIABLE MILEAGE PAYMENT FROM $.03 A MILE TO $.06 TO $.14 A MILE SO BASICLY NOW MOST OF YOUR CHECK IS STILL GOING TO ENGLAND , THAY DONT HELP THE DRIVERS THEY MAKE SURE WE GET THERE LOADS THERE ONTIME AND PAY MORE TO DO THERE DIRTY WORK.

I have a thing to say about CR England I came off the gray hound in Indaina the shuttle van picks me up and crashed into a cement median doing 70 the driver is half retarded and now I am collecting workmans comp. what a joke there benifits are they should check there drivers a little more. And will never be the same always in pain

CR England is notorious for failure to pay their drivers. They have had many lawsuits filed against them for it. They even lost a big suit filed on behalf of the lease/purchase drivers last year and had to pay a huge settlement, which as I understand, they have yet to make good on. Not even a court order will make them do what is right. What a great company policy (note the sarcasm)

I have been in the trucking industry since 1991
And I still don't know it all.but I have found that
this is S.O.P. for most companies but any company that has a good reputation usually will pay what is
owed to you usually it's not more then 2 weeks.this is for any fees that you might owe or freight bills you need to turn in or equipmnet you might need to return,or some might just want any logs you were suppose to turn in. after all is settled if anything is owed to you,it will be done within a reasonable amount of time.I have had companies mail a check to my home that I didn't even know I was suppose to get.

FMCSA Regulation on payment to lease operator:

Subsection 376.12 (f) requires the lease to state that you shall be paid within 15 days after submission of the appropriate paperwork:
(f) Payment period. The lease shall specify that payment to the lessor shall be made within 15 days after submission of the necessary delivery documents and other paperwork concerning a trip in the service of the authorized carrier. The paperwork required before the lessor can receive payment is limited to log books required by the Department of Transportation and those documents necessary for the authorized carrier to secure payment from the shipper... The authorized carrier may require the submission of additional documents by the lessor but not as a prerequisite to payment. Payment to the lessor shall not be made contingent upon submission of a bill of lading to which no exceptions have been taken. The authorized carrier shall not set time limits for the submission by the lessor of required delivery documents and other paperwork.

Oh honey you have just began to fight. These people are the biggest crooks in the trucking industry. Find yourself a good lawyer thats what it going to take. My husband has not worked for them over a year and we are still fighting them. They owe us 5000.00 dollars another trucker driver we know they owe over 8000.00 dollars. This is the worse company to ever work for the only thing good was the school and we have since found out there was alot of things they did not teach and were illegal things that were taught. you will never get a penny but you will get a bill.

When a company does this to an ow/op or a driver they are basicly trying to bankrupt that individual,so why not reverse that situation?I personaly had a battle with a carrier from Western Canada went to a lawyer(lair)who told me I would never collect my $5000.00 it would cost me more than that in legal fees!Guess what one ane half years later company phoned and begged me to accept cheque for $5000.00 to that date it cost them $150,00.00 in insurance costs.When I spotted one of their trucks it did'nt move again.Illegal yes,want to collect your money grow a set of big balls stop at Walmart buy some javex and a cheap cordless driil.Be careful and you will collect.

And that is one unfortunate thing about trucking is some companies try to ruin an O/O'S reputation when they leave a company under less then happy reasons. it gets to be more about revenge and less about buisness. a prick for a fleetmanager can give a driver a bad reputation and it will be hard to get companies to see past what a vindictive company says, to actually see the truth. that is why I always have said is document everything, a micro cassette recorder will be your best friend when dealing with dispatchers and fleetmanagers, it is hard to deny what is on tape. the advantage is it makes it real hard for them to ly thier way out of things and can save your butt when going to court. but remember and it is very important that everyone knows that you record every communication for verification purposes,(directions, special instructions) and they have to be told that at the time you are doing the recording. also by them knowing that they are being recorded it is fully admissable in any court if the need arises.

Recording every conversation is definitely a good way to go, but when do we actually get someone to listen to them.

Our occupation is large, and plays a vital role yet we get so little respect. I know more people than I should who have been treated horrendously by a trucking companies, including being forced to work longer hours than the law allows, depolorable pay, and a general lack of respect/

We need to stand up for ourselves, because no one else is going too.

No need to get anyone to listen to them. all it is, is a way to cover your own ass. knowing that you record everything a dispatcher/fleetmanager is less likly going to tell you to do something that they know can't be done legally. also in the event they fire you for refusing to do something you know is illegal it gives you great amunition to use at the labor board and something pretty to send to DOT. as easily as a company can try screwing you, you can screw them back even harder.

When I got out of OTR I owned them money. $125 USX say they paid me to much in Fab 07 LOL. In 8 mouths I made $13000. I only came home 1 time a mouth for 3 days.

simply put, no. check with you dept. of labor. if they are doing it purposely and with malice, you may collect up to 3 times your pay. that is delaware law. yours may differ.
