Like seatbelts a few years ago, now all accidents are blamed on cell phones. Bureaucrats haveto have something to crusade for to make it appear they are doing a good job. I have seen the trains dash cam and everyone is overlooking the obvious...the trucks tires were smoking heavily. The trucks ABS either was not working or was not equipped with it. The do gooders with the cutsie names on there organizations will win and free speech and freedom will be eaten away more....so much for America:(

Years ago the law was changed to allow trucks to stay out on the road longer and this could have been a factor. Truck companies lobbied for this change. It's more dangerous for all of us with tired sleepy truckers on the road.

OK...so I gots me some meany icons...as if...the reality is that truckers had CB radios for years..they would have had the microphone in their hand while they talked and I am not sure if I EVER heard the news sayin' "THAT TRUCKER WAS ON A CB RADIO AT THE TIME OF THE CRASH..!!!!!!"...this is why it is called an accident. Every little tiny piece of the situation is a contributing factor and shares equally in a tragedy.

6Talking on a cell phone didn,t cause that accident, we will never know for sure what did cause it but I think he fell asleep and probably had the cruise control on. Ray LaHood is on a cell phone kick and he blames everything on a cell phone

My vote is for not creating laws to protect the stupid, but protect the innocent. Allowing stupid people to get hurt/die as a result of their own stupidity just helps decrease population. I'd rather not be bothered with other peoples stupidity though, and texting while driving puts ME in danger. So does smoking in public.

I have read in the paper about a number of fatal crashes that occurred as a result of texting or gabbing on a cell phone. As an experiment, I once tried on the quiet country road where I would not endanger anyone to use a cell phone while driving and I just couldn't do it and keep proper attention to my driving. One poster brought up CB radios that truckers used in the past. CB radios are much different in that they do not usually involve long gab sessions and have very limited range making it impossible to carry on conversations with family back home. You don't have to key in phone numbers with CB radios and most calls were about "smokey reports" and other various alerts, one driver to others. I was once nearly sideswiped by an SUV driver yacking on a cell phone one time myself. I say, if you must gab on a cell phone or send text messages, pull over to the side of the road first and show a little consideration to others. My home state still allows all cell phone use while driving, unfortunately.

they can call a ban all they want but until they actually Start doing something with these new laws - it wont matter, people will continue using their stupid phones, causing more accidents and people will die needlessly. laws are only good if u enforce them.

However, in cases of texting and driving there are already laws on the books that state distracted driving is a crime. If we choose to enforce the laws that exist when neglect is ovbious, then we don't need to burnden ourselves with new laws. For example, you can get a speeding ticket going 25mph on the freeway in a snowstorm because there is a law that states you may be ticketed for excessive speed while not exceeding the posted limit. My problem is that you start defining every infraction, and insist on zero tolernce on some policies then you get 'stupid' people enforcing non-sense. Just ask a teenager who was expelled from school if they thought the motrin they were taking for crampes really meets the definition of illegal drugs and violates the schools no tolerence zone. The prinicple who expelled the kids probably realizes it is 'crap' but they have a ZERO tolerance policy. All this legislating needs to end because if we don't stop, someone may get arrested for attempted murder for sneezing on someone....

Someone joked about creating a drunk driving hour and only available on streets far from houses, businesses, and sidewalks. That way, the only people who would get killed would be drunk drivers when they hit each other. I agree that laws should focus more on protecting the innocent. Some people can only learn from their mistakes when there are consequences, so lets stop coddling people and let them face the natural results of their stupidity. I believe texting while driving is more of a health hazard than public smoking. Cancer will kill you years down the road, but a car crash is imminent. In another thread, folks joked that inmates should be allowed to smoke, drink, do drugs, huff spray paint, etc., since that helps reduce prison overcrowding and makes room for more inmates.

A while back I had a guy weaving back and forth down a bike trail, coming towards me. I could see he was fiddling with his phone, probably texting something. Not paying attention to anything else around him. I let him get about 15 ft away and I yelled 'Hey!' as loud as I could. He almost fell off his bike and his facial expression looked like he'd been shot. I just snickered as he passed by.

The problem with too many vague and overly generalized laws is that they are open to too much interpretation and discussion as too what they exactly mean and often get applied beyond the intent of the laws. It is much simpler to ban cell phone use while driving in a specific act rather than depend on a vaguely worded distracted driving law that can be open to very diverse interpretation. Comparing laws banning cell phone use with expulsions from school for legitimate use of Motrin is idiotic and simply underscores how overly broadly written laws can be so nonsensically applied. Lawyers seem to love those vague and broadly written laws as they invite litigation to entangle just what a certain broad term means. How would you specifically define obvious neglect?
