After trying to cancel her Bally Total Fitness membership for more than a year because a worker at the Manhattan Beach outlet allegedly stole her credit card information, Leah Rosett is finally free.

Good for her. She should use her lawyer to take him to small claims court if he will not be prosecuted.
He may not pay up but at least make his life miserable.

I feel her pain, I went to Bally's to renew my membership and the guy who helped me swiped my card twice, thinking it did not go through the first time. But the machine ran out of paper and charged me twice. He said I would be refunded with in 2-3 weeks, after a month of not being refunded they told me to call my credit card company and tell them to give me a credit on the second transaction. Bally's has the worst costomers service EVER!!!! they are good to take your money and thats it.

She signed a 3 year contract with Bally's and should have honored her commitment. The employee stealing her credit card information is a completely different situation than the 3 year contract and should be handled seperately. Obviously her signature, her word, means nothing.

Now everyone knows why identity theft is so rampant. No real punishment for the individual who stole the information (or the business). This type of theft can be solved if the person/business that takes a stolen credit card is made liable.

I know from experience that 24 Hr Fitness wishes it were a pyramid scheme. They offered me a free workout, then collected as much info from me as they could, and would not stop pressuring me to join. Next to the agent's desk was a long list of recruiting tasks they had complete each day. They wanted from me the names of 10 friends/family/coworkers and their phone numbers. I refused. But none of them could top my Amway upline: "Give me that list of names. If you don't call them (raising her voice) I'LL CALL THEM MYSELF!!" Whoa, I already served my time in Air Force boot camp in 1987. No need to repeat it. I lasted 3 days in that organization.

You are WAY off mark there, missy. If a company, through their employee, does something so flagrantly wrong as to allow a customer's credit card info to be stolen, I'd say all obligations to that company are null and void. Would YOU want to continue to visit the place where YOUR identity was stolen? Even if they fired the employee, no one should have any obligation to continue doing business there. Holy moley, where do these people come from? This is news because credit card fraud is a big problem. I am interested and that's why I read the article. I wanted to know if everything came out OK for the victim. I'm surprised that you need to be told this, but DON'T READ THE ARTICLE IF YOU'RE NOT INTERESTED!!! And those pop-ups can easily be blocked, if you know how. Ask a little leaguer to show you how.

Actually, since it was one of their employees that stole her identity, Bally's should have made it right by giving her free membership. Oh wait - good customer services no longer exists!

Good for her. Hopefully she has learned not to join another "health club". Read and Re-read the fine, fine print, and between the lines. There are always "conditions" to everything that fast talking employee is saying, listen and ask questions. Like, what are ALL of the "conditions" to "cancelling" or freezing my membership. Like many big companies, they arent really looking out for the little guy.
