Next move for plant?

Lawyers for developers of the proposed scrap-tires-to-energy plant have not decided whether to appeal the decision to rescind the project's tentative zoning approval.

If the zoning board voted 4-1 to recind the zoning approval to build the plant, who was the only member on the board to vote against it? I didn't see that anywhere in the original story.

Something here is fishy. The zoning officer said "they read much more into the letter" meaning the preliminary approval. He thought everyone could wait and challenge the final zoning if there are problems. Then why would these lawyers go to a court to overturn a "preliminary " approval. So who is misleading who and why? Why is this so important to consider going to a judge who could favor these developers and overturn those who have the intent of the welfare of a community at large. Will the gamble be worth taking? Depends how extremely important it is to cloak this plant with a veil no one will be able to remove nor lift-thus a preliminary approval and go ahead for anything and everything. ERE lawyers said they could "simply" change things to meet code but only if the approval stands? It is a RED FLAG. Do the lawyers for ERE ever mean what they say? The hearing board by voting 4-1 does mean what they say. Erie will need a top notch lawyer to defend their rights to mean what they say.
